I'm wondering who has the legal responsibility for the content of posts and private messages on a web forum, and for that matter of website content generally. What, if any, are the relevant precedents or statutes, and where can I find detailed information?

The person that posts content to a site is legally responsible for it. I.E., if you tape a show on TV and put it on youtube, then you are responsible for violating copyright. The owner of the copyright can warn youtube, and if they don't take action, then youtube is responsible for the content. The copyright holder can raise a lawsuit against the original poster of the content, but they must initially warn the host of the content.

I can't remember the name of the precedent, but it was established recently (this year). The Supreme Court took up the case and made the above ruling.

I always thought it would be the webcreater or host.

but it was on the news that they were not responsible
for what was posted.

They poster was responsible.

Google - Dont date him.com lawsuit
this is where it came into play.
