I don't smoke anymore but if I did I would be outraged. How can some government tell you what to do in your own property? If you are not infringing on the rights of anyone else you should be allowed to smoke in your car and in your home. I do agree that smoking around children is wrong and if there are kids in the car you should refrain.
Why should a government who is very happy to continue to take tax dollars from the sale of tobacco, have the right to define how it can be used? Just my opinion.

Though I understand the reasoning behind it (putting minors at risk to the dangers of second-hand smoke), this law cannot realistically be enforced. There are far more efficient ways of addressing such dangers without resorting to needless and costly legislation.
Edit: Tangerine, the study finds that second-hand smoke in cars is up to 10 times more dangerous that at home. The more enclosed an area, the more potent carcinogens are. However, I agree this has little impact on overall driver safety, which should be the primary concern when enacting and enforcing traffic laws.

I have mixed feelings about it. I'm assuming that the California legislature hasn't passed a law banning parents from smoking around their children in their own homes, so if secondhand smoke is the issue, this law doesn't make any sense, since the children are going to be exposed to the smoke at home, anyway. Also, while I understand the need to protect children from secondhand smoke, I can't help but think that people should be able to do as they damned well please in their own vehicles as long as their ability to drive safely isn't in any way impeded.

I'm a California smoker. For years, I have CHOSEN not to smoke with anyone else in the car, kids, wife, whoever. Even though I don't smoke w/others in the car, I don't think it's right for the government to tell others what they can & can't do (within reason) in their homes, cars, etc. In public places such as restaurants, hospitals, government buildings, OK... But in your own home, car, or even the local bar, I think itr's pushing it a bit. Just my personal opinion.

I don't know, it is kind of nice. I remember as a kid having my mom smoke all the time in the car and in the house, and now wondering how much of that smoke I inhaled. Now i can barely be around people who smoke, and it is probably for the best that little kids are not exposed unnesscarily to smoke, when they are not legally allowed to smoke.

I think they have a point.. and a vision... but a responsible adult would know not to smoke around children/minors. They don't need the law to dictate them what to do. I think the law makers should concentrate more on the bigger problems like the rapid increasing crime rate.

i think banning anything you do in your own vehicle or home is unconstitutional...
personally, i think smoking in the car is gross, and even more so with a child in the vehicle, but unless they're going to outlaw smoking all together, that cannot dictate what you do in your own personal space....
i just quit smoking a little over a month ago, but i never smoke around my kid and I didn't allow my parents to watch him unless they smoked outside. (if he smelled like smoke when he came home, i grounded them from being alone with him, seriously.) I wouldn't be mad if they outlawed smoking, but i am mad that they allow it, but start telling you what to do in your own personal space.

I don't think the government should be doing it. It's bad, but it's not something the government should be mandating.
(I feel the same way about seatbelts and public smoking ordinances.)
