A girl on the internet has posted a personal picture of someone without their consent. They feel very violated and are very displeased, and would like to take appropriate action!

Probably not much can be done, unless she is making money off of the photo.

Unfortunately, if you do not want a picture plastered all over the internet, do not be in positions to get those photos taken. The law is not on this "violated" person.


Peter...think about it...how many photos are on the net without consent. If you think that all of those people could sue, you are dreaming.

you people are naive if you think that you have the right to privacy on this. Do not get a picture taken you do not want to be seen everywhere.

it depends, firstly, only if a shot is used for commercial purposes such as advertising or in a book that is published in the USA is there a legal requirement for a 'model release'.

However for photos of private individuals, regardless of where taken and providing the shot does not show humiliating circumstances or violate copyright there is no legal recourse to have it removed.

Next, under the copyright act (Berne Convention 1971 and DCMA) if the offened girl owns the image or took it herself and can prove it then she can request it be removed.

Notes: Humiliating shots include where a person is subject to personal ridicule via alteration or content of the image, hentai or upskirt or sexually explict content for example constitutes humiliation, also the shot could be in voilation laws of the country where the hosting sever is located.

Where did she get the picture?

If it's violating copyright, she can get it taken down with a DMCA take-down notice.

If she *took* the picture, then the "violated" girl knows her offline identity. What she needs to do is to file suit.

Or else she can hire some kneecappers. That's not legal, but it's much more satisfying.

I think most celebrities would sue the paparazzi for taking and selling pictures of them without their consent if they could...but there is no law to protect ones likeness, so they can't sue and neither can your friend.

so who is this person, only thing you can do is complain to Yahoo, the other thing is did you trade mark your picture? Unfortunately it happens all the time on here people taking other peoples pictures and Nicknames... Bad thing dealing with the Internet

Nothing unless they are making money off of it and than you can sue for the monetary gain off of the picture. My advice is don't take pictures you wouldn't want someone to see.

there would be no tort as the person who's picture it is has not had a financial loss in anyway.
the law does no guarantee anyones ability not to be violated

Start with the website that the picture is posted on. The police should be notified as well.
