They arrested him because he had sex with a 15 year old girl...plain and simple, he broke the law by he being an adult having sex with she a minor, unlawful sexual conduct with a minor...so regardless of the mom's consent it is still a crime. The mother will also be tried for child endangerment, for allowing the relationship to continue, well knowing it was illegal.

They can take custody of the 15 year old and place her in foster care. They will also arrest the 20 year old on charges of statutory rape. The prosecutor will then try to prosecute on these charges but probably will plea bargain down to a slightly lesser charge of sexual misconduct with a minor.
Either way it does not matter. Most states do not give young ladies permission to legally consent to sex until the age of 16. He's going to do time. She's going to be taken from her family and placed under foster care. Both of their lives are now wrecked.
15 is too young to be having sex, protected or not.
Good luck and don't get mixed up in this mess if you can help it. It does not matter if Mom said it was OK or not, the state makes laws to govern over these kinds of things.

Seriously the 20 year old can and will go to jail. Your friend is under the age of 18. Your friends mother could also be charge and probably will if CPS has gotten involved; endangerment of a minor could be one charge for the mother. It is considered statuary rape if someone of age had sex with a minor. Even though the mom didn't give permission for them to have sex the argument can be made that she put her daughter in danger by allowing them to date.

It's called Statutory rape. Because the law or Statute says sex with a minor or under age person ( varies with the state, usually under 18yrs old) is a crime. Because it has been deemed that someone under age is not mentally ready or capable of understanding the consequences of the action. They can put the 20yr old in jail for a long time,e register him as a sex offender and CPS can place the girl in foster care pending investigation of the mothers' responsibilities in alleged allowing of the 20 yr old dating the 15 yr old, and possibly charge the mother with contributing to the delinquency of a minor or child endangerment.

Basically what they were saying was if the mom was not cooperative they would call CPS and the child would be removed until her safety could be determined. They could charge him anyway. Same as in court....... if she appears to not be good and mad about it she will definitly be seeing CPS. She probably will be anyway. That she gave permission placed her child in a position of danger and this will all come out. The mom will probably be charged as well.
4 counts? The guy is screwed no matter what happens as they are not going to drop or reduce all of them. He is going to jail, will not be able to see the girl and be registered as a pedophile. Just that he was charged in the first place will be on his record and his job future is bleak.

What can they do? They can proceed with their charges. Mom does not have to agree to it or 'comply' with it in any way. It's the state that presses charges, not the parents.
The fact that the minor was previously sexually active is irrelevant. The fact that Mom allowed them to date is irrelevant. But if Mom knew/should have reasonably known of sexual activity in the relationship and she did nothing to stop it...well, she can expect to have to answer some very serious questions about that.
Boyfriend needs an attorney.

they can do exactly what they said they would do. the facts are that her mother giving permission constitutes child endangerment and negligence because the guy was five years older and your friend wasn't at the legal age of consent. the sexual activity isn't as much of an issue as the age difference is. depending on where you are the legal age of consent is actually 16 y/o. if your friend had waited a few months, chances are she would have had the upper hand against the law. probably not the news you wanted to hear, but that's the way the law works.

Mom's opinoon has no bearing on the nmatter.
Legally speaking, she is not old enogh to consent to sex. Especially with someone that much older.
That makes him a rapist in the eyes of the law. Nice that everyone confessed. That should make the matter plain and simple in the justice system.
He will almost surely go to jail, and she and Mom and maybe the rest of the family if any will need to agree to counseling and other training if she wants to stay with the family.
Probably he will be prevented from contacting her and vice versa too.
And I am sure just like magic, she will have gotten pregnant the last time they were together so we can all pay for raising it because that is just the way the world works :)

If he at 20 cant find a girlfriend his own age then there is something wrong! That is just not right! The mother should be arrested for letting it happen! Protect your children! There are laws against this for a reason! A 15 year old is not old enough to make logical decisions for themselves! That is why the legal age to be considered an adult is 18! I personally believe that if you are old enough to fight and die for your country then you should be old enough to drink! A 20 year old and a 15 year old ????? He is a pervert plain and simple! He should go to prison! Obviously there is a reason why he cant find a woman his age! He has issues! In my opinion he should be shot and so should the mother who said it was okay! The question isn't whether or not the mother about it but whether or not the child is able to give consent. Your state has deemed that your friend is too young to give consent, therefore it is molestation. They can try the guy on those charges and the severity will depend on the prosecutor. If the mother and the girl aren't pushing for the guy to get in trouble then the punishment might not be too bad.
