My buddy is currently trying to sell his house and he's stuck with a horrible Real Estate Agent. He's trying to think of any way to get out of his contract with the Real Estate Agent, rather then be stuck another 2 months with them. He noticed a mistake made on the contractual paperwork. The Real Estate Agent signed his name in the 'date' field and there is no signature in the 'signature' field. Is that enough for him to contest the validity of the contract and give him a shot at getting out of the contract?

No, that won't work.

BUT, the contract is NOT with the agent. Agents can't have their own contracts. The actual contract is with the agents broker. Have your friend request to be reassigned to another agent. It is no big deal and brokers hear it all of the time. He or she will appreciate hearing that an agent is not meeting your needs and will resolve the situation.

Tell you buddy to call the DESIGNATED BROKER of the office where this guy's real estate license is held.

If you read the listing agreement carefully it says the contract is with the company NOT the agent.

One call to his boss and the contract is cancelled.

P.S. Agents want their clients to believe you cannot cancel a contract so they don't lose the listing, never realizing the contract is NOT with the agent but with the Company the agent works for.

Probably not. However, is he unhappy with the individual agent, or the entire firm with which the agent is associated? If it's just the agent, he should speak with the managing broker to discuss the situation. Perhaps the contract can be transferred to another, more qualified agent within the same firm. It's worth a shot.

How about going the easy way and just cancelling it?

Have your buddy call the listing agent and state that he is cancelling the contract. If he meets with resistance, he needs to tell the agent he wants to speak with the broker.

It is that easy.

No. A signature on an incorrect line, such as you describe, is not sufficient grounds to terminate a contract. If the agency is not providing marketing of the property according to the terms of the contract, THAT would be sufficient to invalidate the contract.

Just tell them and ask them to let you out and most of the time they will.
