I am going to take my ex-landlord to small claims court and I was promised monies and she never paid me the amount she stated to me. I am wondering if in the state of Florida, can a verbal agreement be a binding contract??

What's a non-verbal contract? One that uses pantomime?

If you mean "oral" contract, then yes, they are enforceable to the limits prescribed the local statutes of frauds and perjuries. Typical limits include the amount of money (say, $500), the time for completion (within a year) and the subject of the contract (purchase of real estate, contract for marriage, etc).

Of course, if you want to enforce a contract you always have the burden of proving it exists and that you have fulfilled all of your obligations.

Verbal agreements can be binding in any state. However, verbal agreements involving real estate, especially if for a year or more, are often not enforceable, so it will depend on what the contract was for. A verbal contract is more likely to be enforceable if one party has acted in reliance on the contract and spent money or incurred an obligation as a result that would not have occurred otherwise.

promised all this property was freddies.. & yours to tami meaning650 guy rd & 702 guy rd this is all yours for your security..without me even knowing about it the sold to the county fo 650,thousand dollarsthey told everyone ,not just us that this is all Freddie & tami;s property,,his uncle jimmy was just told that a coupla weeks ago when they finally ran him off.she told him then that this is Freddie's propert eventually one more thing ,the property is in their name..but the way I see it if we can't have it till they r dead..shouldn't it be put in a trust for when they do..they r stealing 650,000 thousand from us they have no right to that money ,when it came from the sell of our future property. pls reply
