I am not on the lease, but I paid half the rent for over 4 months, and the landlord knows it because we set up our rent due date around my payday. Now my old room mate is telling me that she will call the police if I attempt to come get my belongings. Is that such a bad thing? What are the cops going to do that would be negative to me? I don't think the roommate will lie and say that they are not my belongings. I seriously don't even know why she is acting like this. Based on the fact that she keeps asking me to be her roommate in the next place she is moving to and I keep declining, I am guessing her feelings are hurt. The reason I am moving out is due to the type of people that she has as guests, and the high rate of traffic she continues to have. Despite my numerous request to stop all such activities based on the fact that I have a child now and that is no environment to raise a child.

with all this in mind you need to talk to a lawyer, you can sue, or file a petition w/ a sheriff, (if your lawyer advices, the particulars vary from state to state) you and the sheriff can go and get your things, or you can bring them to court and sue for your things,. you have a fav. TV judge, this is the kind of thing they due. but usually just the threat of law suit is enough, but some times sain people act crazy, so if you want your stuff, not a cash payment plan equal to an appraisal of your stuff, you may want to use tact

you have every right in the world to collect and retain ur possessions. tell her you welcome her calling the cops, bc they will be on ur side. did she unlawfully change the locks without u getting ur possessions back, if so call the police, she will be in violation of the law. if u have resided there for longer than 30 months u are considered a resident with or without a lease and ur entitled to collect your belongings. if she forbids you then she is violating ur rights and the police will arrest her not you. i think she needs to smarten up, the only way she can stop u from entering the premises is with a legal court eviction. other than that she is completely int he wrong. so i suggest telling her when u will be there and she wants to call the police u are welcome to it to ensure ur safety and ur items. do u receive mail there? if so that will def support ur claim when the cops show up if she tries to say you don't live there. it will prove u do .

well I would try going to the land lord and asking him or her to sign something saying that they new you were living there as an extended guest ( since you were not on the lease) and see if they will let you into the apt, supervised to retrieve your things. If you recieve the paper signed and are not allowed in by the manager than I would say go file a police report. let them know what happened and that you are trying to get your things back and that she is threatening to call the cops. they may tell you what will happen and what your rights are. and if she does call the cops on you, you already have it on file that you are trying to get YOUR things back. If all else fails go to small claims court and file a report with the court with an itemised list of all the things that are yours and then it will be a court matter and she will be in trouble if she does not comply. good luck

I don't think her calling the cops would hurt anything. It may even be to your advantage to have the cops go with you to get your things. When did you move out anyway? I'm pretty sure that you are legally living there if you receive mail there so that also means you would have 30 days before you had to leave or get your things out. If it hasn't been 30 days then you have a right to be there.

1] Get the landlord to write up a statement that notes the payments to the ex.
2] or, get copies of receipts, check carbons, or other witnesses.
3] go to apartment with friends, to have witnesses [ especially anyone who witnessed a payment, or knowswhich stuff is yours ]. Bring a camera to record all belongings, in case you need evidence.
Also bring any evidence of payment. Then tell her to go ahead and call the cops!
DO NOT:
threaten, touch, or contact her physically [ or let your friends do it either ].

May be she is in love with you or your child. But she don't want to say it. because she feels that will break ur friendship.
speak to her. ask about her future plans, see if anything circles around u.

I think your concern is valid and your ex-roommate is being unreasonable. You should wait a lttle while and see if she calms down, and then try to collect your things. If that doesn't work, get a sheriff to acompany you.

Try calling her and ask her what's going on. Try to talk some sense into her and if all else fails seek legal action against her.
