My Ex doesnt want to sign the birth certificate because he thinks he is not the father(which he is) so what do i do. i want him to sign it but it looks like im ganna end up giving my child my last name but if i do that can i still get chilkd support

you do not have to give your child his last name. that's a personal choice. it doesn't matter if he signs it or not. you can still put his name down as the father.
when you file for child support, name him as the father. it will be up to him to request a paternity test. which the state will require that he pay for, since he is wasting their time by denying it in the first place. it may prolong the case by a few months...but don't let his scare tactics work.

On the birth certificate has this guys name on it as the father, then he has every right to have the little one's name! Also he'll have visitation rights until the child is 18 years old whether you or your mother like it or not! The military will DEFINITLYwithhold child support and mail it to you monthly should you be able to prove that it is his offspring! You should have married this guy because you will get free medical coverage plus base rights (shopping markets, etc.) for as long as you remain married or he leaves the service. Who knows the child might bring you togerther.

What state do you live in? In my state I even didn't have to sign the birth certificate. Only the registrar and the attending physician.

If he doesn't acknowledge his paternity you may have to go to court and demand a DNA test. The getting child support should only be a matter of having it court ordered.

He technically doesn't have to sign the birth certificate, that doesn't mean he's not the father. The child doesn't have to share his last name either. Once you go in to DSHS to file for child support, then he will have to prove that the child isn't his.. To do this, they make him take a paternity test, (which he ususally has to pay for ) if he refuses, then it is assumed his, and they will make him responsible for it.. !! Good for you in collecting child support.. My sister won't, even though her ex is an idiot!

The last name is not the issue. DNA IS.

If your EX is so sure that he isn't the father, he should be more than happy to get a DNA test.

In any case, the "Father's name" on the birth certificate is only evidence and Lord knows it isn't perfect evidence since a huge portition of the people listed as fathers on birth certificates genetically COULD NOT have been the father.

If he's not sure it's his kid then you'll probably have to get the Courts to pay for a paternity test, before you even get child support. But legally the child does not have to have the fathers last name.

Force the paternity test issue. This decides the child support issue. If he disputes it and the results indicate he IS the father, I believe he ends up paying for the test. If not, then I think it falls on you. This is what i've heard in Texas. Either way, you need to have the test done.

you can give the child your last name but you will probably have to get a lawyer and sue for child support in order to get him tested for that. He probably thinks he can avoid child support if his name is not listed. The name really isn't all that important because once you meet a dependable guy, you can always change the last name again to that.

No he doesn't have to have the fathers last name. All you have to do is do a paternity test to prove the child is his and he still has to pay child support.

In order to get child support, you must prove paternity.

Give the child you last name. Why would you want your child to grow up that jerks name.

Get a paternity test ASAP.
