I was diagnosed with RA, it's pretty agressive at times & the FMLA would be for days when I can't function normally.

FMLA only applies to employers with 50 or more employees. As such, yes they can.

FMLA is designed to cover days off here and there on an as needed basis
BUT it does not affect companies with under 50 employees
Also, if you change jobs and go to work for a larger company they do not have to allow FMLA coverage until you have been employed for 1 year and worked at least 1250 hours in that 12 month period.

Not allowing an employee who is sick to leave is not ethical. Yes, you should step in and say something. Some people on here might feel that it isn't your place to do so, but forget them. It's high time that employees stand by and help each other out against stupid bosses like this. When you're working around food, it's nothing to sneeze at. What if she had puked all over someone's food? they shurely wouldn't have wanted it, and probably would have sued the company. Then, the health department would probably be called in. Does the boss really want that? and people often wonder why people complain about their bosses online and so forth. This is just one reason why.If anyone should be written up, it's your boss. I might add, he should be fired too.

RA can be very aggressive, but FMLA isn't designed for a day off here and there. If you work with your doctor you should be able to find a regimine to help manage your symptoms.
