I am dealing with a very difficult Ebay buyer who has been abusive from the outset.

I sent his order via secure mail, but he chose not to pay for delivery confirmation or tracking.

He has now filed a Paypal dispute against me saying the item didn't arrive. If I can't provide Paypal with tracking or delivery information they will automatically refund him in 5 days time.

How am I supposed to contest his fradulent claim if he didn't pay for confirmation?

I seem to be in a lose-lose situation.

Yeah, your screwed. This happened to me. I learned the hard way too. You have to get delivery confirmation. I just include the cost of confirmation in with shipping cost. Confirmation protects the seller. If you can't provide confirmation number PayPal will always rule in favor of the buyer. Ebay and PayPal are good, you just have to understand the rules and the risks or you can get burned.

Have you tried explaining the situation to ebay and paypal?
I hate to say it, but YOU were the one who should have provided the tracking number if you shipped the merchandise. And you should have listed that in your shipping stipulations.
The dispute only means that Paypal has a record of the payment transaction, but they will try to settle it fairly from both sides. That's why you need to inform them of your position also.
There is no such thing as "secure mail" without a tracking number. So, next time hopefully you have learned a lesson and will provide this info in your shipping information on the site.
If the buyer contacted you via email and stated that they didn't want to pay for confirmation, then you need to forward that email to ebay. This is the only thing that might save you.

You can't win in this situation. You the seller are required to have proof of shipping. This is one of the conditions on the seller protection program. If you would of been SPP eligible the case would of been win-win regardless of the outcome of a buyer complaint or chargeback. Since paypal and customers have no physical interaction they cannot tell who is lying and they do not go by word of mouth. They ask for proof of shipping.
