I just moved into my condo as a renter one month ago. My downstairs neighbor has complained twice to me that my one and a half year old son walks too loudly. He has now placed 2 complaint letters to his Home Owners Assn. He constantly looks up onto my balcony to see if what I have there (which is a bike, bbq, and chair) and to see if I am in violation somehow. He has had several arguments with his wife since I moved in, constantly slams doors, cusses, and now has gotten another neighbor friend of his involved. His friend has now also stated that they hear noise coming from my condo. I do not have parties, I rarely even have visitors, and their is no excessive noise. What rights does he have to take action against me? Is there actually a possibility I could be kicked out?

I would also file letters on the noise from his apartment when he argues. Even if you do not complain you should document all contact. He does seem to want to have you kicked out. You may ask the HOA what you can do to solve the problem since they will know its impossible for a 1 1/2 year old to walk too loudly. I bet he wasn't happy with the last tenant.

Whatever you do do not get yourself into confrontation with this man or any of the people you think are siding with him! Unfortunately many things have changed for the worse in the world, including this country, and you must protect your RIGHTS the very best way possible. FIRST, I will tell you it isn't your child's walking that bothers him. He is in for you and will stop at nothing to get you out, and will probably call the police the minute you become a bit upset at him and speak your mind out loud. KEEP YOUR COOL and do not address him.

SECOND: As soon as possible go through Yellow Pages, and briefly tell attorneys, their secretaries, assistant or paralegals your situation. First go through the REAL ESTATE ones, since many or most handle landlord/tenant issues. Many times attorney himself will talk to you right then and there. If not, any of those working w/him or her, will relate your message and he will call you! If they don't take up these cases, any in his office will tell you right away. If by any chance no attorney will advice you on what to do, because of condominium regulations, etc., and this man keeps harassing, personally go to police station, and in best manner possible, explain you cannot move from apt., and since your sole preocupation is your child's wellbeing, you need for this man to stop this. They'll know what to do.

THIRD, and most important: Don't give up, especially if you like the place. REMEMBER today you'll be giving in to this injustice, next time to another. And for one reason or another you'll be giving up on a lot of your rights.

I'm assuming that since you are a renter that you have a lease. Do you have carpeting on your floors to help muffle the sound and if not does your lease state that you must have carpets? Sometimes that's put into leases in case someone complains. You're probably not the first person he's complained about. Sounds like a bit of a nutter. Good luck.

Keep a diary of the things of he says and what he does to show your housing authority. Perhaps you could make a tape recording of your son walking around your place so you have that as a back up. Don't let your neighbour get to you. Some people just don't like having kids around and maybe thats his problem.

The man sounds troubled . When he's out why don't you bring a pie or cookies to his wife and chat with her . Two heads are better than one . Or you can invite her up for coffee and let her see for herself that your toddler is just a normal toddler .

Either your kid weighs a ton or your neighbor is just a tad too sensitive.

just write or go and see your H.O.A... and tell them he is harrassing you.. start keeping notes of what he is saying and doing., they may offer to move you, inconvenient it may be.. but at least you'll have a bit of peace,.. good luck.
