I work for a small company in CA. Before this, I worked for a short time at a big co. making a great hourly rate but I felt out of place. When I heard about my current job, I went for the interview, and the owner told me everything I wanted to hear. She said that she'd match the hourly pay I was getting at the big company. The catch was, I had to quit that job right away and start the new company. I did it.
Now when I came here, there was 5 regular employees: all women. At first everything seemed fine, until about 3 weeks in, when I was about to face a couple weeks with 10+ mandatory OT. I asked the owner what the procedure was for OT. She told me that I was now going to be paid salary & if I wanted hourly it'd be $2 less/hr. Next she got disrespectful, yelling at me and then picking fights with another girl, saying we gossip about her (a lie) and almost fired her for no other reason. She acts crazy. I wish I could quit but I need unemployment, & I don't have any job offers yet. Help!

Well the boss is the owner of the company, it's a small company and there is no HR. In fact, her receptionist quit too, which is when the owner started acting really weird - sometimes saccharin sweet (seems fake) and sometimes distant and terse, sometimes downright rude and aggressive. I've been looking for other employment, problem is I have not found anything in my line of work. I'm a graphic artist working in a moderate sized city, I can't exactly take a holiday job at a retail store and expect to make even half of what I'm used to. I have a feeling she is treating me and the other employee badly to make us want to quit, then we can't get unemployment. Does anyone know what I should do so I can get out of here but still get unemployment to help pay my bills until I find another job?

You shouldn't have to put yourself through this. If you are being cheated and disrespected then, my guess is that you need to leave. You shouldn't really try to go over her head, because that is just going to make more trouble for yourself. There are some places that have HR that you can call if you are too afraid to go anywhere else. Other than that, there isn't much you can do there. GET OUT NOW! You can always find a job else where.

Absolutely. I'm sure you have a contract somewhere that specifies what you get for commissions, and unless it says that the money can be withheld at the manager's discretion, then they can't do that. Tell your boss that you want that money or you're going to go to a lawyer, and then follow up by actually consulting with one -- I'm sure you can find an employment lawyer in your area to represent you on contingency. You really don't need any other points to argue -- the money is yours and this guy stealing from the company is completely unrelated to you and your commissions. Furthermore, I'm sure that as a rental car company, it has insurance against employee theft or other fraud. They don't need to take it out of your pay to make up for someone else's crime.

Start looking for a job while you are working at this one. It sounds like your boss has mental problems. Stores are hiring Christmas help now. If it gets really bad, you can take one of those jobs.
