Hello,

I got my H1B visa this month (I've had the TN visa for a year so far) and my current employer has given back to me the social security and medic aid deductions that have accumulated since they hire me. My employer will also not deduct these things any more.
However, my former employer had been collecting social security and medic aid but have not got that refunded yet.
Is there any way I can apply for the refund?
I still have the pay stubs from my previous employer.

Sorry, but you are not entitled to a refund of those. Your current employer erred when he gave you the taxes back, and is making a costly mistake by not withholding the taxes now. You are subject to SS and Medicare withholdings as any worker is. This is true for TN status as well as on an H1B visa.

When in TN status, you receive credit back home (Canada or Mexico) for the SS and Med taxes and wages paid in the US. Ditto for working here on an H1B visa.

This Agreement will exempt all Social Security Taxes that Indians pay in US and transfer all the Social Security taxes we have paid so far to Indian EPFO accounts.
