Depends on the maturity of the child and which judge is presiding over the case. I've seen cases in NJ where a 12 year old girl was allowed to speak for herself as well as her 2 younger sisters. However, I was told they should be 14. My 10 yr. old son wrote a letter to the judge and that along with the statement of a counselor was heard by the judge.

in ny----the child has to be at least 12 years of age.....there has been cases where the child was 9 or 10 that had the chance to decide where they wanted to live but it is very rare that it would happen. Good Luck
