My friend's cousin got in a fight with 2 other individuals one night and ended up getting slammed on my car hood wrestling around. This totaled my hood putting about 11 dents and dings in to the hood. The vehicle is a 2005 sports car and the cost to replace the hood and match the paint is $1100. The police showed up but there was no police report. This happened about 2 months ago after dealing with the cousin and after he agreed to pay the $1100 I haven’t received a penny. Can I take this to small claims court? There were two eye witnesses. I’d rather not go through insurance due to the risk of my rates jumping up since I had a claim 2 years ago for someone breaking in the vehicle. My insurance is Progressive…

Also keep in mind i have a $500 deductible I'd have to pay to have my hood replaced if i went through insurance.

Who are you going to sue? Your friends cousin b/c you don't know who the other two people are? With out a police report you're going to have a hard time.

File a comprehensive claim and get over it.

I'm pretty sure that the answer is no. But if not, the answer should be no. It sucks that it happened, but why would you consider someone who #1 had no control over the situation and #2 had no part in it, just because it was on their property. I would have to say that you are not a very good person for considering this and you better hope I am not on the jury if you do can and do sue, because I would say not guilty about halfway through the first sentence. Welcome to America I guess. Sh** happens, it sucks. Deal with it. You can sue who hit your car if they find them and get the $500 you are entitled to. That's the only thing you should be able to do.

Yes, you could sue. Not having a police report is a detrimental factor though. Having 2 witnesses does help. Take him to Judge Judy.
