I have a "paper and tissue" modded slim ps2, (its a mod without soldering) and swap magic disks. This console can play burnt ps2 games. I was wondering, if I sell just the console and the Swap magic, is it illegal? Will I get a big email from the fed saying I owe thousands of dollars? How do I know I'll be safe?

Selling a modified PS2 is NOT illegal, even if the mod allows the person to engage in illegal activity with the unit (i.e.: playing burnt games).

Mods automatically void the warranty. That's about the extent of it!

Sending the burnt (i.e.: PIRATED) games with the unit IS illegal. Using the unit to burn games - for distribution - is illegal... Burning the games and using those discs instead of the game discs that you purchase is NOT illegal. It is termed "Fair Use," and is generally accepted. They've been allowing that since the 60's when blank cassette tapes became available (record your music onto the tape to keep the record in mint condition).

If you REALLY want to be sure, contact a lawyer, especially one that deals with Copyright law, and has no personal stake in the entertainment industry. ;)

Usually ebay will pull ads that are against their rules if they find them or if someone reports the ad. That is probably the worst.

if what you are doing is illegal and you know it, why do you feel safe posting it on Yahoo?
