No, definitely not in a lot of cases. But, it's at their discretion as long as they do everything legally. These days, you hear "a good fit" mentioned in ads and interviews--this means they are going just as much for the personality as everything else. I have had some unfair interviews in my time, however, reflecting on it makes me glad I am not working for a person who is like that.

at the end of the day the interviewer wants someone who will do a good job.
If there are more than one who they think this applies too then they must decide on other things, like if they will like working with that person, if they think they will fit in, if they will be committed, if they are nice to the rest of the staff etc.
So fair or not, the interviewer is still doing the best they can in most situations.
There will still be some who give the job to an old friend or whatever but you cannot root out all that anyway.

interviews are tough! we win some and lose some... unfortunately that's the way it is.

unfortunately interviews are not only about whether you can do the job... it is just as important that there is a personality fit and they can see you getting on with the rest of the team!

try not to get down about not getting a job. the more interviews you go to, the more practice you will get. try to be yourself and sell yourself as best you can.

there's a job out there for everyone.... sometimes it just takes a little time in finding the job for you!

Most try to be. But I think the most unfair thing about the process is when a interviewer will not even let you know if you made it or not. You have to remember that you are dealing with personalities and how they have been trained.
