Long story but my husband asked for 2 days off for my sisters wedding out of state. Well he asked and they told him that they expected him to be there those two days. He is in the union, and does not have any time left to take off during the year. My question is what if they fire him when we get back, if we went. Would he be able to get unemployment. Obviousily this company doesn't care about family. So he is going to look for a new job! So do you think he would qualify for unemployment? Thanks!

He would not be quitting.. he would go back in on the monday, but if they fired him then I guess they would fire him. My thing is he is in the union wouldn't they help him? And also I think they have to give him like 3 things, like writing you up. Then suspending you.. before they can fire him right?

No. Unemployment comes from being released from a job, not from quitting, which is what your husband is doing by going to the wedding.
From the employer's viewpoint, the guy just didn't come to work and was "fired for cause." The union contract will support this. A guy can ask for time off, even unpaid time off, but if the time off is not approved, then he MUST go to work or be considered a 'no show' for which he will be fired.

Was this wedding a surprise?
Maybe he should have planned ahead, and if it was a surprise, it might be a good idea in the future to leave a few vacation days until the end of the year for just such an occasion.
If you've been told you can't have specific days off, especially if you don't have any vacation time left , and you don't come to work on those days, you're going to get fired.
Is a wedding important enough to lose a job over?

Ask for voluntary layoff if he works for a big company. He could be on it as long as they want him to be though. But at least he still would have a job. But they are right in telling him to report for work since he does not have any more days left to take off this year. Also, most places I've worked at require a month notice for leave.
He should be able to collect unemployment, since he was fired (even if it was for a cause like someone mentioned). For example, I have a friend who was joking around with someone and stupidly called them a midget (and he was actually shorter than than the other person), and got fired when she decided later on that she didnt like that and said something to management (in which she then got his job). He collected his unemployment with no problems. I dont see why your husband wouldn't be able to.

Yes he would qualify for unemployment but would he deserve it? No!!!! Whats the matter with society. Since when is he entitled to more time than alotted. I would understand perhaps if it was a death in the family but come on a wedding and chances are yall were aware of the wedding for quite sometime. I'm afraid I disagree with you totally. His company expects him there because it is a buisness that needs its employees. Your husband knew what the rules were when he signed on with the company regardless if it is a union shop or not. If the company doesn't allow wedding leave, and most don't then he should have saved some of his vacation for it. Otherwise he should go to work as expected.

If he chooses not to go to work in order to attend your sisters wedding the company are completely within their right st terminate him for Insubordination as he was specifically instructed to come to work those day and he didn't. How bad would it be if you went to your sister's wedding without him. It may be worth it in the long run.

He would need to discuss this matter with his union rep. or president. Usually there is an absenteeism policy in most union contracts and it allows for a certain amount of time off per various circumstances. Doctors excuse is usually one of them and it would not count against him. Times have changed and your right, they may not seem to care about families but bear in mind, abusers have helped to cause a large amount of the problem along with corporate greed.

it would be considered insubordination, he refused a direct order, there is no 3 step for insubordination and the union can't help. if he is terminated for cause he can't collect UB
