If A friend of my wife came to our house and left periphanelia there and the cops came looking for her at our house. She had left but the police asked to search. When her friend left my wife found the parephanilia and put it away in the drawer. The police found it and charged both my wife and I for it even though I wasnt present. If my wife admits this to the prosecutor will they drop it against me. My worry is that I have priors (non-drug related) and they will think that she is just taking the fall for me. I am really concerned about this because I have changed my life and am doing good and dont want to go to prison.

It was in your house, in your drawer it is yours! pick better friends and if you have a record, you shouldn't have anything to do with this type of behavior yours or a friends. you can argue that you do not use drugs, but if you already have a criminal record it will be hard to be believed.

1. IT IS BOTH OF YOURS HOUSE UNDER LAW(S) AS COMMUNITY PROPERTY APPLIES IN MOST STATES.
2. YOU AND YOUR WIFE CANNOT BE COMPELLED TO TESTIFY AGAINST OR FOR EACH OTHER YOU ARE MARRIED.
3. A GRAND JURY WILL CONVENE TO DECIDE IF A BILL OR NO BILL IS WARRANTED FOR A CASE.
4. THE PROSECUTOR WILL THEN CHARGE THE CASE FOR A TRIAL DATE.
5. IF YOUR FRIEND IS YOUR FRIEND SHE CAN BE A THIRD PARTY TO THIS CASE AND PRESENT EVIDENCE TESTIMONY THAT ALL THIS STUFF WAS HERS NOT YOUR WIFE'S AND YOURS.

IT IS UP TO THE PROSECUTOR AND THE POLICE HOW FAR THIS CASE WILL GO.

I doubt they'll drop charges, specially if you have priors. It is possible though, if your wife, and her friend exonerate you. But a question, I'm thinking is,, why didn't you just throw the paraphernalia away or call the police to let them know what you had found ??? I'm sure law enforcement was thinking the same thing.

Precise language is critical. How did the police search your home?
Did they have a warrant?
Did you give permission?

Do you always put away drug paraphernalia when you should not have it? There was no garbage can anywhere in the neighborhood?
