Well it appears my brother and his X wife dont want to press chargers based on the presumption that this may impact thier daughters mental health. I thank you all for your answers!

Okay, first..... if the sex was consensual..... I don't know what the laws are like in your state. In some states, the age of consent is 16. In other states, it is 18.

I am 27 years old. When I was 18, I was LIVING with a 28 year old man. We had sex regularly and I can tell you, my thoughts were very adult.

IF ANYTHING, when I was a teenager.....I was often the seducer. If I saw something I wanted, I went after it.

I had friends who did the same and some of them would LIE about their ages to these men. Which I think is WRONG and HORRIBLE. Some poor guy has no idea what the heck he's getting into..... and ends up getting arrested - or with a "rap sheet" like the one you've posted.

Consider these things: 1)Did the man know how old your niece was when they first got involved? 2) Was the sex/relationship consensual? Is the girl distraught or does she seem to be suffering in any way? 3) Are HER PARENTS okay with the relationship? Do THEY want to call the police? 4)How mature is your neice?

Talk to HER parents. If they want to call the police, why don't you let THEM do something about it? Otherwise, I'd stay out of it. I'd hate for you to get involved in something where there could be a potentially bad or retalitory occurence.

What's the age for statutory rape in this state? If it's 16 yr
then you basically can't do anything to him. What the hell are you doing to your niece about this and his rap sheet doesn't have any sex crimes on it to support this question. If your niece is of legal age, the authorities might be wondering about her guardians and why she's able to associate with this type of guy. Careful what you ask for, when it comes to teen girls & older men, you could wind up in hot seat with her freedoms.

Absolutely. He's a pedophile now, report him and send his butt back to the slammer before he rapes some 5-year-old.

I can't imagine what is wrong with you that you would even have to ask this question. You should have picked up the phone and called police the minute you found out about this.

The answerer below me is dead wrong. Your niece was underage and what he did was completely illegal. Technically, she could not give legal consent and so in the eyes of the law he raped her. You don't just talk to her and ask her to please not do it again, you call the police and put this guy back where he deserves to be. This is a much more serious offense than the break-ins he has done before. He is facing a very long time in jail for this.

Certainly, as soon as possible, for the main reason that she's a minor. If the old man has some sense he should not allow this to happen and destroy the innocence in that girl. As a concerned family member, you should report this incident to the authorities.

ONLY two responders gave you the correct answer. And that is, you need to inform us where this occurred so that the laws for sexual battery, statutory rape and/or Aggrivated sexual battery can be researched.

Simply because he has a criminal records in no way proves he committed a crime. Neither is the fact that there is such a wide disparity in ages.

And anyone who gave you a different answer is a legal idiot.

Wow, I wonder if every state has public rap sheets like that...?? That was pretty cool! I'd love to see my husband's ex wife's rap sheet!! She's been arrested at least once and just got a drug conviction. (in CA)

Anyways, this Loser is a sexual predator and should know better than to have sex with a 16 yr old. What are you waiting for?? Call the authorities NOW.

The age for sexual consent in Michigan is 16. Legally, there is nothing to be done.

This means: minor corruption. Did she agree with it? Did he force her? Was she seeing him? Didn't you know she was seeing him? She's just 16, she can't really take care of herself. she doesn't know what the world is full of.
what's done is done. i don't think you should notice the authorities because i don't think he raped her. but you have to talk to her and explain that what she did was wrong, that love is something you should do with the man you love and that loves you and who is ready to protect you no matter what. let the past be past but protect the future.

He's got to be reported! He's looking at a minimum charge of statutory rape, AT THE VERY LEAST, and as far as I know in most states it's a crime to be privy to a statutory rape and not report it as well so it's a responsibility to the minor to do so.
