The company may not even know this, have you talked to them?
If the sizes advertise a specific capacity, check and see if the cup holds that. It may just look the similar. If you can get the advertised amount of ounces, no problem.
If you can not get the advertised amount, your state should have a food inspector, or Department of Agirculture you could call and complain to. But I would talk to the manger first.
In the mean time, If the small cup is cheaper, you are getting a deal. Buy the small cup and you have nothing to complain about.

Ah but have you studied the amount of ice they give you? Maybe the way they give you ice is enough to make a difference.
OTOH, I have been to many restaurants, both chain and not, where it would take 2-3 "large orange juices" to fill a "small soft drink" glass, so maybe the cups are not used for the same drinks?
Nothing wriong with asking the folks at the restaurant - a curious customer is a good citizen, and you might get a good lesson in economics and marketing.

buy the small......in essence there really is no small AND medium - its either small OR medium....what they call it is neither here nor there....if you want a larger quantity then order a large.....sorry but grocery chains do it all the time when they advertise...ever notice that you can buy an item at 2 for $6 or 1 for $2.89?....its called marketing and there is nothing illegal about it....they can call it a small, medium or gigantic and charge what they want for it....the only thing you can do is boycott and not buy it
p.s. its kind of the same when you go to b.k. or taco bell or any other fill it yourself place...why order the large when you get free refills?

Bring it to the managers attention. He may not be aware. Then, give them a week or so to get new cups in. If there is still no change in cups, keep going up the chain of command until you find someone who listens.

If it's a big company call HQ and complain. If it's a small restaurant/deli, call the Better Business Bureau. If you don't have to patronize this business, find a new place.

Ask for a printed menu, and see if the drink sizes are printed in fluid ounces. You can test the totals against the menu. If the numbers don't match up, you can report them to the BBB.
