hi could any1 please tell me if i can be sacked whilst on sick leave with a doctors certificate, i am suffering frm a bad infection and my doctor signed me off, can my emplyer sack me fir being off sick, i have only been there a short while and im on my probation period, any advice would be very welcoming, thanks for reading this

Well, it is interesting question but it all depends upon your employment rather than doctor's note. If you are employed as temporary or probationary period, then employers can sack you. Most importantly if you have been issued a contract and has been in a job for more than 6 months in UK, your employer cant fire you but then again it depends how long you have been off sick. The employer also have to consider how unwell you been, it you just got minor infection and few courses of antibiotics and also no investigations and taken 2 months off, they will be very suspicious of your illness. On the contrary if you been admitted to hospital and had intensive treatment and still under care of specialist you still have a chance. Also it is important to seek advise of Union, if you member of one. It always pay to be member of some union, they can guide and advise you about your rights. You can also seek legal advise if you think you have been dismissed or treated unfairly because of illness

It depends on what was agreed when you started your probation. Normally an employer would not dismiss someone for being on short term sick. But all the circumstances have to be taken into account.

yes you can because i have just been sacked and i am on the sick i was with then 10 month you are now with in your right to go to the job center i had a contract and all that and get a pack to fill in

They can not sack you for being sick, but will be able access medical records to see if you are capable of doing the job, if not then they can dismiss you.

I think they can sack you if you're still on the probation period, but someone else might know different. goodluck

if you have worked there for less than 12 months they can sack you without giving a reason - UK

It depends on the company. Most companies won't fire you if you can provide a doctors note. But if your on probation then I think they can fire you legally. They probably won't, but they can..
