Why would it matter? That is like asking if you are happy that you can't be stopped while you sleep at home to see if you you have car insurance?!?!?!?!?!?!?!?!?!?!?!?!?!?!?!?!
A breath test was designed to give a reading for people DRIVING under the influence. And, as another poster said, with the exception of "Zero Tolerence" States regarding minors, that is all we ever used them for.....DRIVING under the influence. There is no "limit" or amount of intoxication needed for Public Intoxication, at least not in California or any other State I have heard of.

wrong the police can stop you and make you take a breath test if they suspect that you are under the influence. they can charge you being under the influence in public.
