i was arrested on 9/30/07 for driving with suspended license. when i was arrest my miranda right were not read is there any thing i can do about that? And also on the "Uniform traffic citation, summons and accusation," they did not have me sign that as well!

please if you think there is anyway i can get out of this reply!

and also please reply if you know i cant get out of ****!

It won't matter.

Miranda only applies if they are interrogating you about the crime; if they did interrogate you without Miranda, then anything you said can't be used against you in court.

Signing the summons is not necessary. You were arrested and therefore aware of the charge.

dont do the crime if you cant do the time.

It sounds like you are guilty and just looking for an easy out on taking responsibility for what you did. But, to answer your question, if you can PROVE that your miranda rights were not read to you during an interrogation, than you may have a way out. Can you prove it? very hard to do. As far as the signing the summons goes, it does not matter

I'll actually side with the police on this one, and I do that rarely.
Driving is a privilege, not a right. You bungled the law by not having your license. You messed up.

When you are arraigned you will be told you have a right to an attorney. If you don't have one by then, then take them up on that offer.

why would you think any of us here in anonymous yahoo land can assist you in your predicament beyond that?

They did not have to marandize you, a suspended license is all the proof they need!~!

Did they question you at all. If the answer is no they do not have to read you anything.

So you don't have a license. So you don't have insurance either right?
