I have a claim against the insured driver of USAA who ran a red light. The adjuster has been unresponsive and hostile, I already filed a complaint against him. But now I must file a lawsuit, small claims court probably. Any info on how to do this?

You don't sue the insurance company. You sue the other driver. Jpne Doe vs. Jane Smith.

Here's an idea - go to small claims court and get the suit papers - write up the law suit and send a photos copy of it to the other driver and USAA adjuster with a letter that says if you do not get a response in 15 days from the date of the letter you will file the papers. Remember to put the date on the letter.

Keep in mind, that once you file the papers and serve the other driver - USAA will hire an attny to defend.

However, most likely USAA would rather non incur 2500 in defense costs defending a small claims suit - so they may respond to your letter. Esp. if they can settle the claim for less than they can defend it for.

Any lawyer will tell you what to do -- for a hefty fee. Be sure you want to go this way -- USAA, like every insurance company, lives in court and has dozens of lawyers (really GOOD ones) at their disposal and will fight like mad once you cross that line.
A suggestion: stop talking to the adjuster and start climbing the management ladder at USAA. Keep your cool, be polite but keep requesting upper management until you get a satisfactory answer or someone that can explain what the problem is between you and the adjuster. I work in a major claims office and I can tell you true that if you act like an as$ that is EXACTLY how you will be treated. No insurance company is afraid of you or your lawyer so only go down that road as a last resort. Who knows? There may be a simple solution for whatever mess you guys are in. Trust me .. only lawyers win in a lawsuit.
