rapist and how many of you if you are married or were to get married would divorce your wife if she was raped and got pregnant by the rapist? I'm just curious because my husband told me that it's an option for the woman who is raped in Islam to marry the rapist. Also if a Muslim woman is raped and gets pregnant what happens to the baby? Does it go into the custody of the rapist or his family or is she allowed to get custody of it? I'm asking because I'm just curious about this and I would like to know how the child would be treated by the Muslim community if it was the product of a rape.

i don't know a man who divorced his wife after she was raped. it is possible that he would and he probably would. i know that some muslim men are still searching for wives that were kidnapped while travelling abroad and they still want their wives back even if they have no children.
in islam rapists are punished, not married . who would marry a violent man let alone a rapist? why?
women who were raped are less likely to get married , very little chance almost none , but they are not blamed by God fearing people although gossip about them will spread by those who are ignorant or friends and relatives of rapists.
so yeah a woman will always be the victim , but islam doesn't say that she shouldn't marry or should be blamed , it discourages people from harming her even by mere gossip which has a very grim punishment.
your husband may have spoken about a certain incident but it sure has nothing to do with islam.
i'm a muslim woman and i just had a conversation with my friend , her sister is getting a divorce because her husband verbally abused her, he never even lay a finger on her. never think that sadists/rapists/criminlas are accepted by muslim women or islamic society , just maybe a few exceptions.

First rape is very rare among Muslims, so it is difficult to answer how common is divorce likely to happen. Second divorcing the wife is a very bad idea during the time she needs her husband most and it is cruel. The rapist has no right and he should be subject to the punishment set by the judge which could be death or cutting his hand and foot from opposite sides or to be exiled. Baby is for the mother to take care of. If it is very early in the pregnancy (less than 40 days) some scholars permit abortion, but it still may be a sin in the view of others. In most Muslim countries child born as result of rape is looked down upon although this is wrong as it was not his fault.

I believe there are very few man all around who have this much courage to marry such a woman. Its really very difficult to decide If it was REALLY a rape or a little of the woman's wish was also involved.

But such pious men shall be awarded if they marry this woman and this woman should also be seeking for forgiveness from Allah although it was not her fault, but some flaws must be there from her which let happen all the case. I'm not blaming the woman but writing out the possible facts.

And there are two groups of people who will accept and reject the child. So, it simply depends upon the psychology of people. But now the time is been changing so I believe people will accept such a child, if not by happily than not even by angrily.

for rape this is a criminal act .thist act is not rewarded,if some one says that is a reward ,yes true so you will see that evry one who wants to marry a girl,then he find a situation to rape her,then the following day he claims her ,and got married.but the case is not so .
to both male and female single unmarried,who has a relation ship ,either they admit it or cought in islam they must be punished
to those married and have it done these must be stoned .but it must be witnessed by 4 adults who had seen the act,4 pple must see the things in the things.or the wife if she claims that her huzbend was involved in act,and she saw him,so her testification is enough to accuse her huzbend(of course or the wife)
lift the punishment off her that she (or he) give an owth four times that he did not do it .then the case is in gods hands
that is for relation ship for singles or married
now rapiest must not go with it
if wife was raped and got pregnant.now there are on tv some series for yusra the actress talking about the same thing
for this as in any other community the ups and downs of the psycho things which affect
and as any other community it takes too many sides to consider

others may have revenge
others would take it to police
now you talking about 1 400 000 000 muslims what reaction they say
but mainly the son which comes out of suich relationship is a son of marriage not any thing to do with rapiest,and he carry the huzbends name.

It is not 'common in Islam' as it is not part of Islam. As far as cultural things go that is different around the world.

Obviously a woman can marry her rapist.....though one would be nuts to do so. It is not something that is suggested in Islam nor would it be encouraged as the rapist is a fornicator or adulterer and it is only permissible for a fornicator or adulterer to marry the like.

Really the questions you are asking can not be answered in the way you want because it is not a religious issue it is a criminal issue.

Brother abal qasam....regarding the last name of the child of a single woman. The child does NOT take the name of the father in this case. It takes the last name of the mother.
The Prophet (peace and blessings of Allaah be upon him) ruled that whoever was born to a slave woman whom his father did not own or to a free woman with whom he committed adultery, then he cannot be named after him and he does not inherit from him, even if the one whom he claims is his father acknowledges him. So he is the product of zina, whether his mother was a free woman or a slave.

Narrated by Abu Dawood (2265) and Ibn Maajah (2746); classed as hasan by al-Albaani in Saheeh Abi Dawood.

????!!!! I have no idea. What I do know is that any woman could marry her rapist if she wanted to - but who would want to? And they are to be killed anyway. We are not talking Luke and Laura of General Hospital here. I never heard of such a thing in Islam. In the Old Testament it says the rapist has to marry her.

Since the baby is out of wedlock I think the mother keeps it. Not sure though....interesting question *Star*

I agree with what lynnsie said too, this does give a bad reputation of Islam. Ask a cleric, it's better. I cannot believe your husband told you such things.

I believe this is one of those areas that Religious and law should be separated, i have great respect for Islam, but a case like this should be handled by professionals in the field, like Doctors, psychiatrist, consulars etc. Koran said that advanced with time and go forward. I think this another amazing fact about Koran and Islam. Advance go forward, don't look back for solutions.

WMD(weapon of mass destruction) gets chopped?lol . I guess there won't 2ND or 3rd offense??!!

Are you nuts? The kind of weird questions you ask aren't giving a good representation of Islam. I live in Saudi and rapists get killed. It is haram to rape a woman and you are asking about them getting married? That's crazy. And probably noone is going to go around and talk about the product of rape just like in the states. Not too many ladies in the states go around and say hey this is my rape child!

The baby who comes as a result of the mother being raped - i.e. the two parties were not married, the mother takes care of that baby. The person who raped her has no rights at all to that baby.

That baby would not be condemned for how it came. No one is allowed to blame that baby for the sin of the man who raped the mother.

I am an American Muslim and so sad to listen to the answers from you guys. I am assuming you are Arabs and as I have seen living in the Middle East you pretty much like to see the things that women do but not your obligations. No woman deserves to be raped no matter how she is dressed!! She will take a sin for her dressing poorly but she does not deserve to be raped. This is so typical. Everything that happens in your households usually comes down to blaming the wife. Well you are the head of the household and guardian of your family so whose fault is it really? It isn't a tricky question at all. I have never seen anything in hadith that says a woman deserves this kind of treatment. The best of you is the best to his wives. Shame on you who are saying that a woman is partly to blame!!
