There's no way you could possibly do this as they would require your critical information (social security number, etc) that stays with you your entire life, and they'd obviously see right away. I doubt you'd even get past the recruiters office.
Plus, it'd be beyond stupid to even take this chance...one of the questions they ask when you enlist/commission is "Have you ever served/been discharged/under what circumstances". Forget lying on a federal form like your taxes, you're subject to far worse penalties lying on your military record. Even if you successfully "re-enlist", if they find out, you're going to prison for a very very long time.

I believe you are asking in a hypothetical sense, but if it does apply to you, then you did not listen to the miltary defense attorney who briefed you and signed off on the form that you were briefed prior to getting the OTH.
No. You likely cannot come back in. The Army is desperate, but I don't believe they are at the point of bringing back OTH guys. A lot of General discharged soldier ARE coming back in however.
When you receive an OTH, you will also receive a specific code on your DD214 at discharge. There are dozens of codes that will be interpreted by a recruiter to determine EXACTLY why you were let go, not just that you got an OTH.
When that recruiter sees that code, he will thank you and terminate the interview process. He can't recruit you and time is money to a recruiter as he has others he has to try to get into the military.
So, you won't make it to basic...you won't make it to your oath, you will never sign a contract. The FBI does not check into it...the recruiter does. The only way you will get to all these stages is if the Army didn't catch it soon enough.
If the Army does catch it, you will be separated from the military for fraudulent enlistment. So, it's not worth going through this process when it could come back on you anyway.

AND If for some reason you made it in before the background check you would be Court Martialed for False Enlistment. Then you would not only get a BCD, but most likely some time in the "don't drop the soap" zone. It's article 80 something. Look it up.

Oh yeah that will work. The military doesn't keep any records on anything so they wont notice that you came back in. Why would you come back to a job you couldn't get right the first time around?

It wouldn't even require a background investigation. They'd run the social security number through the system and it'd automatically pop up showing as DQ'd...

Have you tried merely appealing for an upgrade on your discharge status? Speak with your local veterans affairs office on the process.. and yes, you'd be caught if you tried to reenlist

Your Social Security number would give you up right away. Later checks, if you were lucky enough to slide by at first, would nail you.

There will always be that code of OTH attach to you. They would notice it as soon as you would enter bootcamp

nope won;t be allowed back in., the discharge code would come up the second their SS number was entered into t he system.
