The check is for the damages, not the repairs. Once they cut a check, it's your money. It's wisest to spend it on repairs, but there's no law that says you have to.

As long a you are happy, you are what the Insurance Industry calls, "Made Whole."

If you own the car (no leinholder) then you are entitled to all the money from the insurance company. Period. You do NOT have to repair your car but your insurer may cancel your comp and collision if you do not. It's your car so you can take the check and buy cheese burgers with it if you want to.

Years ago a car hit me but it was my fault. I got a check for $300 to have it fixed but kept the money instead. My car was old and wasn't worth putting money into it. They said it was my money because I pay for car insurance. I did nothing wrong. It's your decision.

A lot of people keep the money becasue maybe the car si not worth getting fixed. As long as the accident wasn't set up, then it is perfectly legal.

The insurance company reimburses you for your damages.
What you do with the money & car is your own business.
If you drive the car, it must be road-worthy & safe.
But if you have another accident don't expect to get more.
