Suppose there was a Superman, and Lex Luthor got some kryptonite and used it and killed Superman. What crime has he committed? Know the elements of the crime.

It would be First Degree Murder.

It was a premeditated murder with a deadly weapon with intent to kill that one person.

That would be a capitol felony that could result in the death penalty or life in prison.

Law enforcement often "gets their man" without knowing the "elements of the crime." They don't care if they ever know the why, though they would like to since it makes everything easier in the courtroom; but they must know the who and the how. The how, here, would be easy to determine since only kryptonite can kill Superman. But I'd like to know, first, how the police determined that it was indeed Luthor? What evidence do they have? Or is this one crime they will never solve?

Supes works and pays taxes as Clark Kent. You kill one, you kill them both. It is still murder, premeditated too, because Lex had to get the kryptonite to do it and used it with specific knowledge that the only person on earth it would kill is the person he is using it on. This is referred to as "malice and forethought" in some states.

The government would still prosecute because Lex has deprived it of future tax earnings that Kent would have produced if he were to continue living.
