Well, it would depend if that legal visitor had voluntary sex with the American. If it was rape, then there would be repercussions. If it wasn't reported to the police at the time, it will be difficult to do that now. So, was it a plan or an accident? And what does that legal visitor want from the American? Marriage? Child support? Ability to stay in the U.S.? Tell me.

Go to her country and ask your question. There are far to many games being played in order to become an American Citizen, your's is just another in the book.
Was it just a one night stand or do you really have feelings for her ? If you have any thoughts or care for her and the baby welfare, start making plans to pay some big money out for your time of joy.

If he marries the mother he has to deal with her immigration status. He may not get to be a part of the child's life if the mother has to leave and he does not go with her. Child support payments might be an issue. He should support the child regardless of what happens.
