You guys are mistaken, this is an empty highway in the city. Its not the type of highway we are all used to. Its the California pacific coast highway, this one actually has traffic lights and it like a big road basically that is in the city, it goes all the way up to the bay area and parts of it run through the city with crossing roads etc. The road was empty and the incident happened at about 4 oclock, the highway was empty, imagine that it is a traffic light but on a highway with other roads crossing it. Its not your typical highway with speeding cars passing by, its totally empty, TOTALLY

I don't think I understand a lot of what you are saying, PCH is almost NEVER empty.

Anywho, failing to yield on highway may mean that your brother may have cut someone off by getting onto PCH or something of that manner. And you personally can't be affected by it when it comes to your driving record, but when it comes to your insurance, I believe it does. When a citation is written, the vehicle is associated with it. And since you guys were in Orange Co., that means you (your brother) will probably be going to court for it, and probably Harbor Justice Center. It's just one of those things that happens. Tell your brother if he is going to drive your car to be a little more safe next time; or at least more aware of who is around.

The traffic that is on the highway has the right of way. If you are trying to enter that highway, then you must wait until it is safe for you to enter, even if you must come to a complete stop to do so. you don't just stomp the gas pedal and try race your way in by beating flowing traffic. This is how rear end collisions take place. Because of the rate of speed upon impact, the crash is generally severe, resulting in severe injuries, some ejections from vehicles, and sometimes death. Also fires have erupted by crushing gas tanks at high rates of speed.

The driver got what he deserved. It should have no affect upon you personally, or your insurance. Your brother did a foolish and dangerous stunt. Unfortunately, he has lots of company. People need to wise up.

it fairly is as much as you the way perplexing you prefer to combat this. the finished therapy will use an lawyer, and in all probability value extra effective than the fee ticket (in spite of the fact that there must be different concerns that could make it rather well worth the combat). the final presumption in this form of an accident is that a vehicle exiting the alley ought to yield the awesome of thank you to any site visitors in the main street. you will ought to instruct which you exercised each and every precaution achieveable as a motive force (which it seems such as you probably did out of your description), and that no motive force on your place could have in all probability prevented the accident. actually, you would be putting the blame on circumstances, the character of the intersection, the habit of the different motorist, or all 3. as an occasion of ways in touch this could be, it ought to pass so some distance as having an expert witness analyze the wear to your vehicle and estimate from that how briskly the different vehicle became going. you fairly prefer an lawyer in case you're going that some distance. My suggestion may be to look for suggestion from with an lawyer who makes a speciality of site visitors circumstances. They understand that the greenback quantities at stake in such circumstances are no longer great (till intense very own harm or dying is in touch), and scale the scope of their centers to in high-quality condition. which skill that they won't bill you for 1000's of hours of artwork in spite of the fact that if it relatively is obvious which you will relatively purely pay the high-quality, yet that if there is an decrease priced protection, they can assist you mount it. At any fee, an preliminary consultation may be unfastened. in case you safeguard this by your self, actually get the witness to show up in court docket, and you fairly prefer them to state that the intersection became sparkling with out site visitors in sight once you began into it. in the event that they are able to't or won't do this (and that they must no longer if that wasn't the case!), then do no longer anticipate to win. in spite of the fact that in the event that they do testify to that, you stand consistent with probability a 50-50 probability of triumphing with out an lawyer. yet another criminal presumption is that in spite of the fact that in case you have the awesome of way, that doesn't provide you the awesome to blindly plow into somebody in case you have prevented the accident. so which you do have of venture to win this, yet you will must be arranged.

if you were to enter while there were other drivers making them slow down or move whatever, then it's because you could've caused a wreck, you saying there was nobody and there is a light, then I would imagine it would be a failure to follow traffic signals. It shouldn't effect you because you were not driving. CA may be different, donno I've only been there twice. If it does end up effecting your insurance, I would fight that one to get it off of your record since you were not the driver.

If the brother was driving, it is his ticket. He should pay for it, not you. The ticket does not go on your record, so it will not affect your insurance.
Failure to yield means he pulled onto a highway in front of oncoming traffic, so as to create a hazardous situation.
I think your brother should defend himself in traffic court. Without video tapes or witnesses, the police cannot prove the charge.

"Yield" is very subjective, you can probably win this one. It's sort of 'slow down and prepare to stop... but you don't have to stop unless you are giving right of way to a main road.'

There are so many things you can weasel into that, that unless you were on video tape, you can win in court. "Oh, but I -did- slow down!" "Oh, there was no oncoming traffic..." "I actually -did- stop," and so on. Unless you were in an accident, take it to court.

It means that you cut the cop off while you were entering the freeway. He had to brake hard, causing him to spill coffee the he was drinking onto his lap. As for how much, that depends on your location, as fines are set at the state and/or local level. And it could affect you insurance, that just depends on your driving record and you insurance carrier.

The person who was driving pays the ticket. If it wasn't you, then it wont affect you.
