i have huge knots and bruises on my hands from being in handcuffs. the officers told me that they had warrants for my arrest for not showing up to court, and didn't let me talk to magistrate, and didn't give me copies of my warrant. My dad went to the courthouse and got a copie of my warrant and it says I was arrested for assualting a police officer and didn't say anything about failure to appear.

the police officer that arrested me knows me personally ... he showed up at my house "by accident" to serve a warrant on someone else ... all of a sudden he saw me, walked back out to the car and then came back and said there were warrants at the police dept ... but we went straight to magistrate's office and never to police dept.

does this sound fishie to anyoen else?

But see I've only been to court one time in my whole life, and I have the paperwork to prove I was there because I had to go to court to pay a ticket! the cops told me that there was a failure to appear warrant but apparently they told the magistrate that I assualted a police officer and that's why my bail was 5000$

how did the cop do his job when he falsely said that i assualted him just to obtain a warrant for my arrest because he doesn't like me personally? my mom dad and sister were there and saw the cops come in and say there were warrants for my arrest for not going to court but the courthouse nor the police dept. has any record of failure to appear warrants against me just one for assualting an officer WHICH I DID NOT DO! HE TOLD ME HE HAD A WARRANT AND I WENT WITH HIM PEACEFULLY

I DID NOT HAVE WARRANTS!!! THIS IS WHAT I'M TRYING TO TELL YOU PEOPLE!! THE ONLY WARRANT WAS THE ONE THAT HE GOT THAT NIGHT BECAUSE HE SAID I ASSUALTED HIM WHEN I DID NOT!!!!! I HAVE WITNESSES TO TESTIFY THAT I WENT WITH HIM PEACEFULLY.

Yes, if you are reporting the facts accurately, you have a case. If you have witnesses, even better.

I would do the following.

1. Immediately visit an attorney.
2. Get signed statements by any witnesses as to your behavior when you were arrested and what the office stated was the reason for your arrest.
3. Pay a visit to the District attorney of your city or county and ask him if he will look into it. If he will not, sue with your attorney. Sue the county (or city), the police dept, and the individual police officer.

First document everything. Hire a lawyer. Get sworn affidavits from anyone you can about the day you were arrested. The lawyer can also subpoena the police officer who handcuffed you, the watch commander, and the person he talked to on the radio. That part will be recorded. Once you have all this information, your lawyer will tell you where you stand. If he believes the case has merit he will carry it through. If he does not believe the case can be won he will tell you that too. Either way it will cost you money. If you win the civil suit the lawyer gets paid from the winnings. If you loose the lawyer gets paid from you.

I can only answer according to what you have shared. absolutely, you can sue the police department, that was slander and unlawful detainment. Make sure you have all your paperwork in order, get you a strong moral minded attorney who will not compromise nor back down to the police department, u r saying magistrate so this lets me know u r in a commonwealth state, if you are not guilty of any of the things they arrested you for, by all means sue, but, be prepared for a tough battle, make sure your witnesses will be there with you because your paperwork and your witnesses will be very important to and for you. I can tell you some of the police officers who have sworn "to serve and to protect" do abuse their authority, good luck to you, I wish you all the best in this as long as you are honest in everything you have shared, its unfortunate you're having to experience this. this can also be considered as "police brutality", you will need to obtain an attorney asap!

Are you in the UK? In the US what you need is a Public Defender. I.e., you have a right to an attorney and a trial. You Need One!. Now, I know it hurts if your family won't stand behind you, but Take This As An Opportunity To Grow Up. Just Fake It! Act very humble at all times. Whatever they say or do to you from this point on, act like a reporter gathering information. Listen. Make note of exactly what they are doing, how they feel or what they believe. Ask Those kinds of questions.

Just learning to trust Him and realize you can't trust anybody else could be the most valuable thing that ever happened in your life! How great it will be if you can learn that early in life!

get your papers in order. Make sure they have the right person, make sure they have the right address get witnesses to sign an affidavit supporting your story, and have it notarized.

Stay cool, stay calm. Bruises heal. Cops are just doing their job. The best advice I can give you sry. Never been arrested, but had to call the cops on someone once, it wasn't pleasant. never is. kind of pathetic actually, so I know some of the emotion. Just have respect for the police and don't do anything belligerent.

I would suggest both you and your father go to the Police station and ask to speak with the Watch Commander, and file a report for this officer's conduct. It will be then put under investigation and they will notify you in writing with their findings.

Bear in mind, that you are not totally innocent here. There is the matter of your warrants. So don't expect the red carpet to be rolled out for you.

Make sure you keep your court date in the meantime and take care of the issues with the warrants.

Get a lawyer. No one on Yahoo Answers can possibly know if there were really warrants or not. You will eventually have to see a judge, and then a list of the charges against you will be read. If there were really warrants, you will likely not win any lawsuit you bring.

Maybe he likes you and this is his way of hitting on you. I mean you are 100% innocent and never did a thing to anybody. The cops and the courts are all out to get you. And this cop has nothing better to do so he hits on you.

If you don't do something about this obvious injustice, all of those involved will be empowered to do it again to you or someone else. It could be worse next time.

It seems like a worthy fight to me. I would exhaust departmental remedies before suing, though.
