My 9 yr old stepdaughter was sickly every time she came back from her birth mothers, starting in Dec. Each weekend she would come home & be sick and I would take off work to take her to dr. We would get her well and her 'mother' would take her for the weekend & she came home sick every time.
In March I took her to the emergency room bc she had slept all day. She would not eat or anything. Her pulse ox was at 82%. They airlifted her to a childrens hospital 3 hrs away. She was in Pediatric icu for 4 days and on the floor for 3 days. My husband & I have custody (the 'mother' dropped the girls off at our house when our son was 1 1/2 weeks old.) She doesn't work, recently married and does not pay her court ordered monthly support of 150.00. What can I do?

When she was strong enough & stable enough for testing, we discovered she has asthma & allergies. She is VERY allergic to cats, her 'mother' has 1 mama cat & 5 kittens living in their 2 br 1 bath house. Asked her to get rid of cats and she and husband called to say they had took them to animal shelter. When I pulled up a few weeks later, guess what I saw?! Was in court end of Aug and child support office is trying to make her pay 1000.00 within 60 days and her monthly supprt of 150. First 2 years we had custody ahe did not call or come by at all, she moved out of state and was all strung out on meth. showed up motherday weekend 2005 with law in tow(make sure we let her get the kids). Crazy lady, been arrested 2 x at my house for not leaving. She will stand in yard and holler & cuss, scream, throw things, and I usually end up calling the law bc the kids freak out and I own my house, I don't want the schitzo acting an *** at my house.

First you can get a restraining order in place that stops her from coming by if she does call the police. Next if she isn't paying her court ordered child support why isn't she in jail? Make her life as miserable as she has yours and you can bet she will go away...

I about the only thing that you can do is based on the fact that your stepdaughter is coming home sick and was in the hospital to try to remove the mother's visitation rights.
Did you find out what was wrong with ther to stay that long in the hodspital? There may be drugs involved or something else.
At least she would not be going there and getting sick again.

As far as the money is conserned. If the parents have joint custody then I would imagine the the mother should be responsible for half the bills, you need to look at the court decree as that may specify it.
However, if she does not pay the support already ordered, what are the odds of you getting money for the medical bills.

Also, go back to court about the child support.

First have a doctor make sure that the mother is not poisoning her I know that it sounds strange but it happens everyday. Second get a lawyer and talk to him know in our case she has to pay half of any med bills precreptions and another med dental vision bills thats in the court orders so read the papers and see if it in there. As for the child support you can contact the Child support unit in your county or state in turn her in for past due child suport they will start taking it out of her check if not working then she could go to jail. The mother is only responsible for any medical bills if it is stipulated in the court order. If it is not stipulated then I advise your husband to file for modification to add it in there. Also, that could be a good time to address the health issues. Sounds like you would never receive anything if it were in the court order because she can't seem to pay a measly $150. Good luck to all of you. I understand how frustrting all of this can be for you.

I'm not sure where you live, but in PA medical expenses are covered under the child support Order. The custodial parent is responsible for the first $250 per year. Expenses above that are split between the parties in proportion to their income.

I doubt that medical bills could be added to child support...it should be stated in the divorce decree who is carrying the medical insurance on the child.....I would be more concerned with why this child is coming home sick every time after visiting her mother....something is very wrong and the mother needs to be investigated.

Money should come last. Your step daughter's health is more important. Document her illnesses and the time-frame of them in relation to the visits. Subpoena doctors if you need to as proof of how sick she was. Get the visits stopped. Even if it means you lose the money, so be it. $150/month isn't that much money. Cut costs if you have to. Buy used clothing or generic brands of soap, toothpaste, food, etc., or even give up cable if need be. Cut this woman totally out of your lives. Your daughter might die if she spends time with her biological mom again.

Definitely go to court. This sounds SERIOUS. Get an excellent lawyer and pursue the issues. It is worth the money because you will recoup it.

Take her to court and have her investigated for abuse. What is that "mother" doing that makes her child sick every time she goes over there?
