The other grade horses I've bought through the years were from friends and people I knew so we didn't bother with it.
This weekend I am going to look at some and I called the guy and they are at his aunt's house, he says some are his and some are his brother's, he doesn't know which ones his brother wants to keep, I have to be there when he says, doesn't sound to eager to sell anything even though he had an ad out. Something just doesn't feel right.
If you think I need a bill of sale, what should it all include?

Absolutely get a bill of sale! And another safe thing to do is to write the information on the memo line of your check too. On the bill of sale just have the age, color, sex and any markings, brands and scars, if any. Make sure he signs the bill of sale also. It does sound fishy though. Is there anyway you can request that his brother be there to? That way this guy doesn't sell a horse he isn't suppose to. Another thing, make sure he puts the address that your purchased them at. And proof of his identification...sounds bad but that way you have something to compare his signature to and if some asked me for proof of identification on selling the horse...I would provide it. Also, save the ad that brought these horses to your attention. That way if something bad does happen...you will be able to show the judge that ad.
I helped a friend out by buying a horse from her and when I wrote her the check...I put the information there too even though she gave me the bill of sale. Better safe than sorry...=)

If something doesn't feel right - then I'd back off and go elsewhere. Trust your instincts!

Years & years ago we had a new boarder who just bought a beautiful Arab from a son whose mother had died - reason for the sale. About 3wks after she started boarding him the police called asking if we had any new horses boarded in the last month - we did and the description matched this new Arab. Long story short, then son lied - mom wasn't dead at all, he had just sold her horse to get drug money. Even with a bill of sale, our new boarder was out her money & horse.

If you just feel you can't walk away - such as the horse(s) need to be rescued and taken to a new home - then in addition to a bill of sale listing the horse's indentifying marks (prominent scars, tatoos, branding, etc.), take one or two witnesses with you. DON'T PAY CASH!! Use a cashier's check or money order - something you can trace to show that you made payment in good faith to the 'rightful' owner. If these horses are boarded at a barn with other boarders, then ask around to see if the other boarders have heard what's going on. You can also talk with the regular treating vet & farrier - they might know something too.

Firstly, I would never take a personal check as payment on a horse --- a deposit, maybe - but never a payment. Payment should be in the form of cash, money order, certified bank check - anything that is guaranteed payment.


Secondly, as a personal preference - I ALWAYS get a bill of sale, no matter what I'm buying, or who I'm selling to. Some of the horses I've bought have had their bills of sales written on a scratch piece of torn - off paper and scribbled ink, and that works well enough for me; but I prefer, if I sell a horse, to do a slightly more formal, computer printed out copy.

Make sure both buyer & seller recieve (and sign) the same copy.

It can contain anything you want. My bills of sales usually include the horse's info - name, breed, age, gender, height, color.... both party's personal info from name to telephone & email and mailing address..... cost of the horse.... and any important notifications that the buyer/seller are aware of...

i.e...... when I bought a horse that had navicular, it was clearly stated on the agreements we both signed, that I was fully aware of the horse's condition and unsoundess. When I sold a horse that could not have spurs used on him, I made sure to put that in the written agreement.

If you have a 3rd party involved in this sale (the brother), I suggest you get ALL INVOLVED parties to sign the sales slip --- both brothers, and whatever other aunt's and uncles that can claim responsibility to the horse --- and be sure to identify in your sales slip exactly whom the payment was agreed to be given to.

That way, if there ever were to be a problem, you have 4 signatures (and yours, so 5), stating that you all agreed to pay this person such and such an amount for this horse.

The sales slip doesn't need to contain a lot of info, but it should *** BE SPECIFIC***.

ALWAYS get a bill of sale with a description of the horse (age, color, height, markings, etc) and any information that is important (such as a known health issue.) Getting a bill of sale has nothing to do with whether the horse is registered or not. It's about having a legally binding contract that states you as the new owner of the horse.

Get a bill of sale also having them say the horse is sound to the best of there knowledge.My friend bought a paint it was fine on there property the next day at her house it was a nut case she called the vet out & she told her the horse was drugged.She got screwed she has a nut case & nothing in writing about the horse.

Always get a bill of sale with any animal-even a grade, or mixed breed. It's a matter of legal security. It (or a contract) should describe the horse, and return policy, as well as any kind of health guarantee.

as finiky as this guy sounds i personally would probably cancel my visit to them. if he has an ad out he should know which horses are his and whihc arent and which are for sale and not...etc . something does not sound right to me.I say on this issue, forget the bill of sale, forget the personal check, trust your gut which is saying somethign doesnt feel right and don't go. whta is lost from not going, you save the gas money and you save a possibly hurtful situation too. I'd look elsewhere

Even with friends, or family, you should ALWAYS write up some kind of bill of sale that you date and both of you sign.

You don't watch court TV, do you? Friends and family DO end up suing each other over such things. You need to make sure you do it with people you don't know, but you should go back and do some kind of sale paper with friends or family if you've recently purchased from them.
