Usually if the tree is healthy their insurance will pay.This can vary from state to state.

A few years ago my dad's healthy oak tree was damaged during a thunder storm. A limb fell on his shed and on a small back yard apartment (both were covered on his policy). Another limb fell on the neighbor's carport and laundry room. My dad's insurance paid to fix his shed and his back yard apartment. They also paid to have the rest of the tree cut down, and they paid to have the limb that fell in HIS yard removed.

My dad's insurance did not pay anything to the neighbor or even remove the parts of the tree that fell on his property. They advised the neighbor to make a claim with his insurance agent.

I run a tree service here in AZ. and run into this on occasion. the tree belongs to you, but your insurance will not pay for damage to your nieghbors house unless you have an insurance policy on the tree. your neighbor will have to file a claim with his/her own insurance, then they have the option of suing you for any difference in the cost that insurance does not cover. home owners insurance covers your house, cars and other buildings ON YOUR PROPERTY not that of your neighbors.

It is your tree and your insurance should pay for the repair.

As far as I know, bits of trees in a neighbouring property are their concern and care. They can cut branches off your tree in their space, so they should be liable for it's upkeep.
