I'm looking for the easiest way to file, we would also have to file custody as well. Pretty much everything is under agreement as of right now, unless he decides he wants to be a jerk. I saw an attorney today and the price was just way out of reach for his hourly rate, and I just can't afford it. I know there are ways to do it, but I'm clueless. Thanks! =)

Hazydaisy, in Canada you can hire a Para-legal to represent you in place of a lawyer. So I guess that it depends on where abouts you live and what their rules and regulations are in regards to filing. One of the ladies that I work with just last year ended up using a Para-legal and she screwed up the paperwork so she ended up having to hire a lawyer after all. Her man is playing dirty and it has cost this woman thousands of dollars but she feels that in order for her to be able to keep her home that she must do so. Hopefully you and your husband will be civil towards each other during this time and not try and screw each other before the courts. Best of luck and do check out with the courts as they may even have a mediator to help you resolve this divorce, saving you both lots of cash.

Yeah! My Ex and I did this about 15 years ago. What we were told by the court was this: As long as both parties are in agreement and there is no evidence of coercion, the court is just a witness to the agreement. If there are children, the court will examine the agreement more closely to ensure the children are being treated fairly, being provided for, get adequate time with each parent, etc etc. Biggest question is ; do you trust each other to honor the agreement? I had physical custody of our 2 kids and not only drove halfway to her city to ensure visits as scheduled but also volunteered to do it as often as she wanted when it wasn't scheduled. She always paid support out of her pocket and I never doubted that she would do so. You have to do what's best for the children and leave the personal feelings toward each other out of it. One other thing though: You need to check the laws for your state. Some states allow this - - others do not.

Yes you can. Go to the court house and ask for the package for devorice with minor children fill out what you want then file it and serve your ex then after you do that and show proff that you serveed him then set a court date before you go to court you and your soon to be ex sit down get eveything agreed to and in writing and then go before the Judge and say that you two have agreed to these treams if the judge see no threat then he will agree and sign the order and you will be done. But it all depends on what state you live in to I don't know all of the rules and how to in all the states just Ca, AZ, TN, TX, AR, OK, and it's pretty much the same in all of them so maybe it will be the same in your state good luck. You can even agree on an amount for child support too. so get it all wrote down and sign it in front of a notery

Good luck with that one sweetheart! I had an uncontested divorce and the courthouse told me I could file myself for $350 (chicago.)

If your soon-to-be ex hubby doesn't agree to the things you are seeking. GET A LAWYER!

It will save you TONS of heartache, trust me!

I divorced LONGER than I was married! That ain't no lie! It makes things so much easier if you hire a lawyer, and a lot of them, if you go through your courthouse, will work WITH you :)

If children are in the mix and custody is an issue you might have to get a second job to pay for the attorney. Ask your local courthouse about it. I got my divorce for ten dollars. And I had two kids, but my ex was a drug addict always in jail.

you can try the Legal Aid Society but I strongly urge you to get a lawyer to protect you and your soon to be EX.

without a lawyer, it can always be reopened, up to challenge that you didn't not have legal counsel and didn't know what you were doing. you don't want to renegotiate this later on.

Go to a parallegal..but only if you have NO kids and married less than 5 years..otherwise it wouldn't be smart if you have children and need $.

yes, LegalZoom.com has the papers you need to file.....you fill them out, sign and take to the courthouse to file along with your filing fee....$60 - $200.00; the is the petition....then he gets served.....and it goes from there

or....get your attorney to make him pay for your attorney fees....that happens a lot too

Yes if you go "uncontested" meaning you both agree on everything look at doing your paper work online. It costs around $300 total and you guys can split that.

Yes, but it has to be simple and amicable. You can go down to your county courthouse and get the forms.
