I believe that the Cities can do what they want in regards to smoking bans as long as it isn't lesser than what the State's stand is on it...in other words, a City can't allow smoking when the State has banned it.

That is a city law. Cities ban smoking in enclosed areas.

both, either or neither. whoever decides to act first gets the "credit", or shame in my opinion. give it a decade or so, and if the cities and states having made "acceptable progress" towards anti-smoking legislation, then the federal government will step in.

Cities and counties can make their own laws, but they cannot overrule the state laws (such as smoking in state buildings).

Wherever you are, as a general principle, it is being enforced by the "police department", "municipal corporation", and the "civil department" ... of the local place !
Any of the officials from any of these departments will be having the power to charge you for breaking the rule !

In Massachusetts and New Hampshire, it's the state that does it.
I support wholeheartedly as a forever non-smoker.
I'm tired of having my health affected and my clothes smelling of someone else's disgusting habit.
