I asked a question earlier, and everyone gave me strength and support to fight for my sons rights. He is in first grade and was denied water as a form of punishment. What everyone didn't know is my sons a fighter too, he told me today that he held on to the school bus and kept begging for water, he didnt want to give up. He finally had to physically be carried on the bus. Jake has had test ran to see if he had a tumor for his excessive thirst, but thank God none was found. He layed on the floor that day sobbing and shaking, scared me too death!, I still cant believe they wouldnt just let him have a drink to quinch his thirst after giving the children an extra recess on a warm day, and every other child got water but my son. My husband got a simple apology from the teacher, but the principal hung up on me. She said I was just mean, because I was outraged. She wanted to tell me how nice the teacher was, and I didn't want to hear it. Now I need legal help, but dont have a lot of $. Thanks

Not every problem has its resolution in a court of law.
You have no standing to sue anyone. Your outrage does not constitute damages under the law.
Finally, love him though i'm sure you do, you have to accept that a deaf 6 year old is not a credible relater of fact. There's no way his story is true, no school would ever deprive a child of water.
Don't bother a lawyer with this, you have no case.

I read your other question - and I am sorry to say I am not nearly as warm and fuzzy about the situation as the other "outraged" parents.

Your son was denied a drink - not dehydrated or locked in a hot box on school grounds. He has no known medical condition that warrants immediate administration of water.

His behavior was a problem at the time - and disruptive. I don't feel the teacher acted agregiously. Unless in addition to deafness your child suffers from other issues as well.

If my daughter came home and stated I wasn't allowed to go to the drinking fountain because I was acting up - then I am not going to back her negative behavior I am going to reinforce that correct behavior is warranted in school.

I hope you do not find a lawyer to take such a frivolous lawsuit. I'm sorry - it was a drink - get over it.

You don't need an attorney. Contact the State Board of Education in Columbus. I went through so much in Ohio with schools that I finally drove to Columbus and got all the books that contained childrens and parents rights in education. Just "plopping" those books on the table at the local Board building got a lot of attention. I got everything I wanted.plus.

Want to save some $. Then why don't both of you pay a visit, in person, to the school and ask what's going on?????

Or, has everything come to sue first, ask questions later. This probably isn't what you want to hear, but why not give it a try???
