- I think you mean-...' its better to leave the Security deposit?

no way! Dont! If he doesnt give it back to you- tell him
you are taking him to small claims court- Chances are,
this guy does it to all his tenants- not fair and its not right
dont let this ******- get any extra money of yours!!
fight for it!!! Im routing for ya!!!
I just went through a similar situation- had a terrible landlord
and he didnt give me back my security- well, I got it back,
plus interest in small claims :)

If you didn't sign a contract, then there is no deposit to speak of. You just gave him money, and he can claim it was for any reason. Unless you wrote a check to him and specifically put on the check that it was a deposit, I would consider it gone.

Depending on the state you live in, he technically cannot just keep the deposit. He has to give you an itemized list of how much he spent to get the apartment back to a reasonable condition. If he doesn't supply this, you can fight to get it back. However, this is in California. Also, you have to ask yourself if it is worth the hassle.

I assume that the deposit is = to 1 months rent, simply don't pay your last months rent and he can take it out of your deposit. good luck

It's probably better to cut your loses, and just forget about your deposit. Most landlords will do what they can to not give it back to you anyway.

just asking where was your apartment located?
only asking because, I just got an apartment yesterday and the old man said he doesn't like to make people sign leases because people sometimes end up having money problems and they cant stay there full lease.

How much are we talking about?

If you can walk away from a few hundred dollars as opposed to fighting this jerk, then I would say forget about the money and move on.

Hope this helps.

He will!
Don't bother to clean the apartment when you leave.

I know if there happens to be a decent landlord reading this I will no doubt get a thumbs down.
