My husband and I seperated over a year ago. Since then, he has moved another woman into the house and put her on the accounts. We also own a business but my name is not on it. I have no access to any paper work for it has been hidden from me. We have two children and I have no money. We recently tried to get back together. I lived in the same house with him for two weeks and we were intimate. He however, will not move his girlfriend out so I am leaving. He is dying of cancer. He is on stage 5 so I am not sure how much time is left. I don't want to be left with nothing but I don't know what to do. Do I have rights legally or will she get everything as stated in his will?

We live in North Carolina but I will probably leave to go to another state closer to family. I am not sure how that changes things. I don't have the money to pay a lawyer so I really don't know what to do.

Not a damn thing if he sets it up correctly. Only way you may get something is to divorce him now. That is if you can prove you helped with the business. That is the way it works here.

im sorry but we cant really help u.. u should really contact a lawyer in ur state who can tell u more of what ur entitled to and go after it for u. u can't do this alone even if u are well informed by people around u. u will need legal help. try to find a lawyer that u dont have to pay until the case is settled since u have no money right now.

woman, get to a phone and get yourself a lawyer before today is over!!!!! or do you want to be husbandless and penniless and homeless??? if there is a business you need to know TODAY what that business owns and where the money is. his money, that is, YOUR MONEY.

you are making me weep with frustration, you are legally married and separated and wonder if some strange woman can inherit HIS property? IT IS YOUR PROPERTY, AND HIS DEBTS ARE YOUR DEBTS. he cant put her name on anything, you are his legal partner. has he got you this fooled???

this is what lawyers are for!!!!! you need a lawyer. if you still dont know what to do, go to the phone book and look under 'family law'. find a womans name and call her office. a female lawyer. who does divorces. tell her girl who answers the phone exactly what you have written here. ask her to help you. i GUARANTEE they will help you. tell them i said so.

for you to say you dont know what to do, your husband is dying of cancer, you need to speak to him immediately. with a lawyer. this lawyer can help you, immediately. any money he has in the bank is your money too. this lawyer can get his money frozen before he knows what is going on. this is to protect you. but it can only happen if you get your head out of the sand today and get to work!!!!!

can i say something to you? you should have done this a year ago. now you may be in big trouble. but you need to face this. if you dont do this, right now, you may face a life of poverty and all sorts of other problems with his business that you may not even have thought about. tell your lawyer i said so. now, for heavens sake, get on the phone!!!!!! please dont be a fool !!!!!!

Are you in a community property state? In most states everything automatically goes to the spouse. Have you talked to an estate attorney? They would be the ones to help you. If he is able to will everything to her, you could probably contest it on behalf of your children. If he was dying and this woman took advantage of him...

A current will supercede any previous ones written if there truly exists a current one. Now you can slapa judgement against his estate for say child support owed or whatever in which his belongings can go to you to satisfy that debt, but do so soon if youre going that route

If you are married to him when he dies you and your children will have rights to part of his estate but so will his girlfriend since she is taking care of him while he is dieing.It sounds like a sad deal all around.Good luck

talk to an estate attorney about how the law handles these situations. If you haven't divorced then you may have claim to assets even though he rewrote his will.

you may be able to contest the will saying he wasn't of sound mind and body because of the cancer.

If he has a will, you got a long fight ahead of you. Why did you go back with him knowing he has a GF?
