I have been married for over 4 years. We have never consummated the marriage. My wife tightens up so bad that penetration is impossible. She has promised to seek counseling and to seek medical help, but she never goes to more than 1 session. I feel that she has continued to keep me under false pretenses, believing that this situation would not be a permanent one. I no longer believe that we will ever make things work in the bedroom. Can we seek an annulment? We got married in TX, but currently live in CO, can we file for an annulment here, or do we have to do that in TX?

If you have lived in Colorado for 90 days, you can file there.

Colorado is a "no-fault" divorce state. You can file for a divorce there without going into all of these embarrassing details. So you should consider why you would choose an annulment instead.

If you need an annulment for religious purposes, or you feel it would help you in the financial settlement, then see a lawyer.

But generally, "false pretenses" is only relevant at the time you got married. For example, if she knew she could never consummate this marriage but promised you she could before you married her, that might be grounds for annulment. If it something you both discovered after the marriage, it is not.

Annulments are granted for those whom have been married for a year or less no matter which state. You now have to petition for a divorce... an uncontested one if she is agreeable to it.

If possible and you both agree, get divorce in TX due to it's fairness, and lack of alimony... among other benefits.

Many people are now using divorce mediators because everything is arranged and settled before you go to court, and judges normally grant divorces quicker when it has already been mediated.

Here in NC you can have a marriage annulled only before the marriage has been consumated, or by reasons of adultry.
There is no time limit on these actions. You need to have the annullment done in Colorado because that is where you live.

Wow. I think that you can only get divorced, but damn, no sex in four years married. I think it just goes to show that pre-marital sex might be a good thing, in case of a stuff like that.
