My friend was in Germany in the Army years ago. Met his now wife and brought her home to the states. They got married in Sayre Oklahoma. THey later moved back to germany where she has citizenship and lived there for many years. She had an affair on him,got pregnant, and he took a job in Iraq. While working in Iraq for two years he claimed residency back home in Oklahoma. She filed in Germnay for legal seperation and they have been seperated for a year now. The father of the child has been living with her in my friends and her home for the whole two years he has been in Iraq. She put his name on the birth certificate everyone knowing the baby ins't his. He has now moved back to the states and has been residing in Texas since August. NO divorce petition has been filed. CAn he file in The US to divorce her? Does it have to be in Germany? Will the US recognize the divorce in Germany when they were married in the States? Does Germany recognize their US marriage? Help..advice!!!!

I have been listening to this stuff for over two years...it's time for him to divorce and begin to move on, he just needs someone to point him in the right direction....

Yes I agree he needs to hire an attorney, but where? he's already got a german one, but I don't think the divorce needs to happen there since he doesn't reside there and the marriage didn't take place there......what a mess.....

he has kids with her and knows well where she's at as they resided in that german home together for years so nope can't do the newspaper thing......

oh no he is not responsible for that bastard child, not if he files in the US...he can have a dna done on it and prove it isn't his....the end....

I was married in germany, came back to the states 11 or 12 years ago. i filed for divorce in Georgia, the type of divorce where you post an ad in the local newspaper for a few weeks, and if no response, divorce is final, and cost me around $400. You just have to tell the courts that you do not know the location of the spouse, that you have no mutual children, or other needed settlements. I did not have children and the property wasn't worth fighting for.

Once i had the paperwork, I sent a copy to her. Done!

In case there are children and he wants custody, then he will have to find a local attorney specialized in international stuff.
Once things like custody and child support are settled, a mutual arrangement is made, and documented, the court would not deny him a divorce. It's called a settlement agreement drawn up by his attorney and signed by his ex-wife to be. Not sure if the german courts need to agree with it since the mariage took place in the USA, and the children are probably US Citizens? If the children were to make it to the USA, the mother would have a hard time taking them back out of the country.

Hire an attorney. File for divorce in Oklahoma. Time for him to move on...........

if he has residency in the US he can file from here.

bummer about the kid though. because he was married to her when the kid was born, it's his and he is responsible for it

He needs to hire a lawyer and he can then follow his advice.
