Law and Order has not gotten this right until recently.
First of all, the death penalty is by state law, not city law. Since June, 2004 New York State has not had a functioning death penalty. It was declared unconstitutional by the state's highest cour.

I am also a Law and Order fan. Law and Order has had several programs where the death penalty was an issue and whoever writes it doesn't seem to care whether they are wrong about New York. New York State has not executed anyone since 1963. On Law and Order there have been at least two executions I know of- one a woman who decided against all appeals and the other in the episode where Briscoe later got drunk and Claire died in a car accident.)

Since 1995, New York has sentenced 7 men to death. None of them has been executed. Only 4 have had their first appeal.

As much as I love Law and Order, I wish they would get the facts straight.

The death penalty isn't a city power it's a state power. If New York state has the death penalty, then a person who commits a crime in New York City can get the death penalty. Assuming it was a capital crime. However, that would be up to the prosecuting attorney and a judge at sentencing if a death sentence were going to be considered. Nonetheless, the death penalty only applies to certain crimes.

Technically, the New York _state_ has the death penalty. However, in practice, it has not been carried out since 1976. Furthermore, in 2004, the death penalty (or rather instructions to the jury regarding its imposition) was ruled unconstitutional by NY Supreme Court and currently requires legislative clarification. Basically, it means that in practice, there is no penalty in NY state.

The state of New Jersey also has a similar moratorium since 1976.

New York State has the death penalty but I believe it is very specific, such as killing a cop.

No, I beleive the only American state that still enforces the Death Penalty is Texas
