I work at a Japanese restaurant, and as of late, my boss (the restaurant owner) has been splitting tips with me and the rest of the workers. Yes, she helps out, but only about 15% of what the waitresses do... the rest of the time she's just talking with customers or eating and chatting with her friends that come in to eat. But when it comes time to split tips, she splits it evenly among herself and the workers! I can't describe how incredibly furious I am...........

I paid my way through college witressing. NEVER did the owner split our tips, which we already shared with bus people, the hostess, and sometimes the bartender and cooks!!

I don't know if it's legal or not. That's a great question. Remind me to give you a star. I wish a lawyer would answer this question! Is there a law category? I'll have to look. Then I'll ask it! I don't blame you for being furious. That is so out of line. I wonder what the manager would say.......The more I think about it, the angrier I get for you. It's just not fair.

I DO think all you waiters should tell the manager about this. Or is the owner the manager too? You're probably just screwed. If you do find out it's illegal, you should all take some action. That SUCKS!! >:-<

Not usually, at least not at McDonalds and such. In a 'real' restaurant I sometimes do, but it really depends. When there aren't any other customers and I still wait an hour until I can order something (as was the case in a Pizza Hut... and more than once ^^) I don't, if there's nice staff I do if I happen to have the extra money.

I've heard of places that do split tips among the servers and I think that is totally unfair. The owner is in no way in-titled to any part of the tips.

What your boss is doing is illegal. The customers leave the tips for their SERVER. Your boss has no legal right to your tips and you have the right to report her to the labour standards boards for theft of your tips.If I found out that the manager of a restaurant was stealing my servers tips I'd confront them and demand the tip back and give it directly to the server.

i've worked in the service industry for years
and i've never had to share tips with management
let alone owners
tipping out bussers and bar-backs
is at you discretion
if you have been coercecd into doing so
you are being taken advantage of
if you are not working for a corporate chain
and you do not have a union to represent you
call the bbb
better buisiness bureau
they should easily answer you q
(but don't put up with the s***)

I would call your local better business bureau, attorney general and labor board. I'm sure that there is something that prohibits this. The question becomes, how far are you willing to go in fighting it?

IRS rules allow it and the employees must report the IRS rules on tips..there's an avg..and guess what...it's 15%.
