If someone owes over $8000.00 in back taxes and have yet to file for about 3 years ( not included), what would be the best way for them to go about paying off their taxes ( a little at a time if possible).....or do they need an attorney or can they call the IRS and set up payments?

First and the most important is to file all your returns. IRS will not consider any of your request for the installment payment unless you are current on filing your returns and paying current taxes. So start with your 2006 return with the tax payment. If you have some reason (medical, casualty...) for not filing your return in time do attach a statement.

Then complete and your previous returns and send whatever payment you can.

You can set up installment arrangement. But, I think, only after you get a balance due letter from the IRS.

If the balance due is less than $25,000 you may be eligible to use Online Payment Agreement web application. To access the application, go to www.irs.gov. Use the pull-down menu under "I need to..." and select "Set Up a Payment Plan."

The first thing you need to do is file the missing returns. The IRS won't even speak to you about payment plans until you've done that and established what you actually owe. Once you've done that you can set up a payment plan pretty easily.

You can set up payments with the IRS, but you'd have to file the returns first.
