And is an illegal alien. The police cited him and towed his car, but meanwhile my car needs a new front fender. If I sue him how can I make him pay? And if he won't pay with a judgement how can I collect? And can I even get a judgement on a non U.S. citizen?

Here's the easy way

Call your insurance company - file an uninsured motorist claim. Your company pays you under your policy and then collecting from the illegal alien becomes their problem. In the mean time, you get your car fixed and move on with life.

You don't, simple as that. If you carried uninsured motorist coverage, you'll get your car fixed, but if you have injuries, you would have to take the guy to court, and they will give you a judgement. Problem with a judgement is the enforcement of it, if the guy doesn't work or doesn't work above the table, there isn't money to garnish. If he quits his job and gets another, you are constantly trying to keep track, so you can file the paperwork to garnish again. Getting a judgement gives you power in the courtroom, but it's pretty worthless afterward if the guy simply doesn't want to cooperate. The non US citizen issue is a non-issue as far as I know, you could still obtain a judgement.

It stinks, but they are right...you have to file with your insurance. Find out how much the damage is first...it may not be worth the risk of increased premiums to have them fix it.

It also stinks that the insurance companies can raise our rates when we get hit by an uninsured motorist. I'm sure there are drawbacks, but I wish we just paid at the pump for insurance...at least for minimum legal requirements. Then, no uninsured motorists driving around. Underinsured would be better than no insurance.

You don't. You can try to take them to court, but they most likely have no money anyway. It sucks, huh? I should have said you could sue them if you can find them to serve the papers.

Pray about it because their is nothing you can do but take your losses and file a claim with your insurance.

The only thing you can do is vote Republican in '08 and let your own collision policy take care of the damage to your car.
