I carpet was soaked and began to smell moldy and of mildew. We called the rental office day after day and they kept saying they would send someone and we waited almost 2 weeks. I'm pregnant and couldn't even sleep in m,y bedroom b/c of the terrible smell (had 2 sleep on the couch). I ended up ripping out the carpet in the room because it was nothing that could be done for it. We had it professionally cleaned & everything. Anyways...our lease will be up in december and I was wondering if we could have it replaced (if so, how?) or should we just leave it as is (i know there is a strong possiblity they will try 2 charge us...but they never came!!!)Thanks in advance.

It is THEIR A/C unit.

COWBOY- the A/C is in the ceiling in a closet. We placed a bucket under it but the a/c leaked thru the wall which is also ruined. So NO since the A/C in not like a window unit...the was NOTHING else that could have been done. Alot of people are allergic to mold and the carpet was moldy which could have been harmful to my baby which is my number 1 priority. I am not paying rent to sleep in my living room and I made hundreds of attempts. I did what i had to do but thx anyway.

It's their responsibility to take care of it. Just be sure you keep all receipts and records of your requests for them to come and fix it. Legally, they cannot charge you for it since you put them on notice that there were issues with it. If they try to, you can certainly take them to court and dispute it.

I hope you have all this in writing. If your notification to the office was only on the phone or in person, they can deny you ever told them about it and sue you for replacement of the carpet. How long has it been now? I would send them a letter stating what happened, how they never came, and how you had to tear out the carpet due to mold (tell them you could not tolerate it and have a mold allergy, which you might very well have if you had to sleep on the couch). But do get it all in writing and maybe even send it registered letter so they can't deny getting the notice. If you tried to do the right thing, and have it in writing, but they still try to take you to small claims court to be reimbursed replacement cost, you should be okay. If you have a deposit down, you will either have to fight for it or forget it. Replacing it might cost a good amount....I would guess at least $300 for a bedroom carpet to be replaced.

It is there carpet but, you knew it was leaking and, let it leak on the carpet. You even tore it out. There could have been ways you could have stopped the water from getting into the carpet.

Yes, it is there problem and, it still is yours for not maintaining it. Tearing it out wasn't the answer. Whether there was nothing that could be done with the carpet was not your decision to make. Whether you were Pregnant or not, was not an issue here, the conditioner was.

Are you saying there was nothing you could have put under the conditioner to catch the water, did you just leave it run on the floor? wasn't there anything you could have done?

I have seen many issues like this in the past, I'm sorry and apologies but, issues and answers have to be addressed in order to get a better prospective of the problem.
If you've contacted them and they've totally ignored you, that doesn't excuse you from not trying, you see what I mean.

go to your land lord/manager and tell them straight up the carpet had to be removed. Tell them you understand they were too busy to come and you will be happy to absorb the cost of having it removed, but that you would now like to have it replaced. Smile nicely and hopefully they will make arrangements to fix it. This bluff has a good chance of making them johnny on the spot, since nobody wants to be slapped with a "bill" from some company for removing moldy carpet from a pregnant womans apt. If they are snitty about it, call or threaten to call your local news, usually there is some guy/gal who does local reporting on "bad service" or "rip offs" they would love the opportunity to play you up as the helpless victim.

Did you document your calls...and did you take pictures of the damaged carpet? If you did...you will have a chance at not being charged for replacement. If you didn't....remember to do things like that next time something happens...it could save you time, trouble, and money.

Was it your air conditioner? If the AC belongs the the apartment then the landlord would be responsible for replacing the carpet. If it was your unit I am sure they can and will charge you. You should read your rental agreement.

Explain the situation to your landlord in a letter.
He should have household insurance that covers things like leaks, etc.
The payout could cover the cost of another carpet.
You can back your situation up by getting a letter from your doctor - mould is dangerous especially to pregnant women.
