I have a friend who went to Africa to marry an African. I am concerned they not be able to come back together.

I doubt it.

Your friend will need to come back to the states, then file paperwork to bring him over. Back in 2003, when the same thing happened to me, the wait was roughly 14 months. She will need to file an affidavit of support, to prove she can cover his and her own bills once he arrives, and also to assure that they won't be using welfare programs..(no sense bringing over another person if you can't pay their bills, in the govt's mind.)

He will be restricted from working for a few months after arriving, until he gets work authorization, so even more reason to make sure you are making enough $$ to support the two of you.

I had help from my congressman in bringing my husband up from Mexico. We had very rare, special but very TRAGIC circumstances, where homeland security got him up here within 2 months. We were lucky in that sense. He came to the usa in Feb 2004, and he just got his permanent residency about 6 months ago, so once he does get here, it is another 3 years til he'll get residency.

I don't know what part of Africa the husband is from, and don't know if there are any special laws for that country, or how they compare with Mexico...just giving an idea of the wait times.

It could be longer now, because of the flood of immigration paperwork coming through, or could happen sooner, if uscis has gotten faster with their wait times. Good luck to your friend. It is a lot of $$ and time and paperwork, and suspense!

No he wont be able to cme to the US, unless he applies thorugh his Us wife-however the porcess will take up to 2 yrs just for him to get a visa. Just becuase he married her doesnt mean he gets a free pass to the USA, she is able to go & come but he has to earn that position & simple marriage isnt enough!

She's already over there? She really should have started the process before she left. He will not be able to just walk in with her.

Tell her to contact the US Embassy over there and see if they can help get the paperwork started.

Yes, She can....All they need is to stop by the embassy with the marriage certificate and she can bring him back to the States...Now ...once they are here ..She and her new hubby need to fill out a form...don't remember which one to apply for permanent resident ( BKA green card)
See INS.GOV for more info

Why, sure... just tell them to get on the plane together and be together when they get to the U.S.... Immigration will welcome him with open arms because his wife is a U.S. Citizen
