A picture of an ex-employee was taken from a co-worker of mine by her Boss. The Boss instructed her that "We do not talk to ex-employees". When she requested to have her picture returned to her the Boss flat out told her "NO".

What rights does she have under Federal Employee Law? Is this considered theft?

He needs to give her the picture back because he is acting childish. I dont know why the ex-employee is gone but sounds like it was not a pleasant exit. Now that the employee knows her boss's feelings, she probably should not display the picture at work to keep peace. After all, her boss is giving her reviews and raises. This is not so much as a legal issue as it is an issue of communication and poor management.
