I am going against my father in court , because he tried to come after me with a knife 2-3 weeks ago , and physically tried to threaten me and intimidate me with it . so i ran outside crying calling the cops . They came and arrested him .
Now i have the proof with me that he was yelling and screaming at me in a high voice in my Voice Recorder ( i got it because that's how much of a scary situation i am in in my house rt now ).

i started rebelling against my father since i was 17 due to his immoral and violent ways that he treated me . I went through depression , panic attack , social anxiety and everything by the time i was 24. . Due to his nature of lying , and deceit , my mom and bro are also with him . They are all going to go against me in the court . They don't know that i have this recording
and right now my mom and dad went to see a lawyer because i told them i am going to pursue the charge against him .

but I am really worried if i will lose this case in court. Will I ?

I must say your story is disturbing. The facts, reading your statement, there was NO physical assault correct? More along the lines of intimadation and fear? If that is correct you have him on verbal assault, which is a minor infraction.. The lying and deceit will be your word against his, and the rest of the family it seems. Have you gotten you a lawyer to work with you on this? If not, and you are going to pursue this you need a councelors advice. Sounds like to me you need to stay the heck away from an angry dad and family. Go your way and live your life and let them do the same. You can't change him or them, but you can change your situation so that you don't have all the medical problems it seems you are dealing with. The tape is not admissable into court, the judge can take it to his chambers and listen to it but it can not be used as evidence. It can sway the judge if he listens to it and help in your defense, but don't put alot of hope into having that. Sorry if I discouraged you, but I've been there and it didn't help me much at all.. Good Luck!!!!!!

If you have a voice recording, I dont see how you can loose this case.
If it was your word against theirs then there is a chance. However, having the voice record is an absolute proof, do the jury will know that you are not lying and they are.

dont worry. Just make sure that you dont lie on the stand, otherwise you will loose the case and may go to jail.

Good Luck

Your father probably needs psychological help... there is nothing right about abuse, and domestic violence... and your suffering depression, panic attacks and anxiety is the direct result of a lifetime of abuse.

Maybe it's time your father got this WAKE UP call!! His behavior is horrible, and i'd also like to say, his father was probably much the same.

Abuse is a cycle.. we live what we learn, unless we choose to change it in our kids' generation.

I understand what you are going through. I was abused as a child too.

I wish you all the best in court...

hugs hugs.

I think you have a good case, especially with a recording. As long as you tell the truth, I'm sure you'll previal. Don't be intimidated by your family's choice to take his side. As long as you stand up for yourself, maybe one day they'll come around.

BE CONFIDENT!
if you loose the case, nothing will happen to you.
if you win, you have nothing to worry about.
if the recording has him threating you, you should be good.
anything you put your mind to you can achieve.
good luck and if i were you i would get out of that house as soon as possible, you dont know what he is capable of, and if your own mother isn't on your side that shows you your by yourself.
keep us posted good luck hunny

Stay calm, have copies of any and all medical data as well as the recording. Just present your case.

You need to speak with your lawyer. You are a grown up and your parents don't have to support you. Yelling is not illegal.
